Back in the thirties, Stephen Vincent Benet wrote a famous story about Dartmouth’s most well known (with the possible exception of Dr. Seuss) graduate, Daniel Webster — The Devil and Daniel Webster. In that story, the devil is not portrayed as a scary figure in horns and a tail but as a more refined gentleman, ”a soft-spoken, dark-dressed stranger,” who “drove up in a handsome buggy.” That’s Bill Ayers these days. It’s a testament to Dinesh D’Souza’s mettle that he even showed up for his scheduled debate at Dartmouth (his alma mater and mine) with Bill Ayers last Thursday. D’Souza is only recently under what is apparently selective prosecution by the federal government for campaign law violations (see “Amnesty, but Not for D’Souza” by Andy McCarthy) and that was probably some of the reason the pundit/filmmaker seemed off his game.
He fared much better debating the existence of God with the late Christopher Hitchens. But that was in part because Hitchens played fair, enjoying the intellectual jousting and search for truth between two exceptionally bright people. D’Souza’s Thursday adversary, Mr. Ayers — former Weatherman revolutionary and retired professor in the College of Education at the University of Illinois at Chicago where he held the titles of Distinguished Professor of Education and Senior University Scholar — did everything but.

She was courteous enough that even President Obama said she didn't "have to pussyfoot around," but the woman who asked about Obamacare gave a pretty comprehensive indictment of the law's rollout and consequences for her family.
"I'm probably not the only one who has had really a panicked experience lately trying to figure if my 10-year-old son can continue with his specialist or not. I know that I cannot keep my plan, which I liked," Rebecca Stewart of Kentucky said to Obama during a Google+ hangout hosted by the White House today. "But as I'm trying to decide what to do going forward, I've spent weeks and days on the phone getting confidently-delivered wrong answers, conflicting information, and it's becoming quite obvious to me that a lot of agencies -- almost every one I've talked to -- is having a lot of trouble figuring out the new rules. So, I'm afraid that perhaps average Americans who haven't had the time or ability to do the legwork that I've been able to do are perhaps going to be blindsided by this."

President Obama repeated the spurious gender wage gap statistic in his State of the Union address. “Today,” he said, “women make up about half our workforce. But they still make 77 cents for every dollar a man earns. That is wrong, and in 2014, it’s an embarrassment.”
What is wrong and embarrassing is the President of the United States reciting a massively discredited factoid....
By now the President and his staff must be aware that the wage gap statistic has been demolished. This is not the first time the Washington Post has alerted the White House to the error. Why continue to use it?...

...The term “cherry-picking” is often applied to the practice of presidents who use inaccurate, narrowly drawn, fuzzy statistics and claims to cover up their economic failures.
President Obama did a lot of it in his fact-challenged, State of the Union address Tuesday night, in which he made exaggerated claims that do not stand up to serious scrutiny.
The Washington Post ran a story the next morning by the capital’s chief fact-checker, Glenn Kessler, under this headline: “Sifting through some questionable claims by the president.”
The Associated Press ran a lengthy fact-checking story, too, with this editor’s note at the bottom: “An occasional look at political claims that take shortcuts with the facts or don’t tell the full story.”
The biggest whopper: Mr. Obama’s claim that businesses have created “more than 8 million jobs” over the last four years....
Unlike Pinocchio, however, apparently Mr. Obama didn’t learn his lesson. On Tuesday night, he declared to all Americans that under his Obamacare law, he has been able to offer a banquet of health care benefits, while “keeping Medicare premiums flat.”
Not true, Mr. Woodward reported later that night. “They’ve gone up.”
Another whopper in Mr. Obama’s speech was his claim that he will raise hourly pay for certain low-income Americans simply by the stroke of his pen.
“In the coming weeks, I will issue an executive order requiring federal contractors to pay their federally funded employees a fair wage of at least $10.10 an hour, because if you cook our troops’ meals or wash their dishes, you shouldn’t have to live in poverty.
This is a cruel political shell game to avoid dealing with the fundamental causes of stagnant wages in a still sluggish economy. Most federal contract employees are already paid more than $10.10 an hour; in fact, often much more. It will not raise the pay of a single current federal worker, only new hires. It won’t kick in until 2015 or later.

Despite the uproar ◼ the FBI closed the case on the IRS targeting scandal before interviewing a single one of the 292 conservative groups that were targeted.
And now Eric Holder will not allow the lead investigator in the case from testifying before Congress.
There are fewer and fewer reasons to trust this guy. Now, we learn this about Obamacare squealers ...
◼ White House didn’t stop ‘flagging’ Obamacare ‘misinformation’ - Website still soliciting informers on friends, neighbors, co-workers - Anne Hendershott and Brian Simboli/Washington Times
In 2009, the Obama administration conscripted citizens to join the government in helping to monitor the emails, casual conversations and activities of their neighbors, friends and co-workers by reporting “misinformation” about Obamacare.
Creating the email address, flag@whitehouse.gov, the administration encouraged citizens to inform the government of inaccurate information — or information that was counter to what the president was telling them — about the health care act.
The response to the attempt to create an informant society was immediate — and angry. Two weeks later, responding to growing public criticism about the idea of neighbors informing on neighbors on the proposed health care bill, the White House announced it had deactivated the “flag” email.
Did they? Despite the administration’s announcement that the “flag” had been deactivated and removed, we have found that today, more than four years later, the email address still appears on the White House webpages (http://www.whitehouse.gov/blog/Facts-Are-Stubborn-Things), accompanied by the same invitation to citizens to report anyone who is disseminating misinformation about Obamacare....
The invitation is still there, and the platform for soliciting and gathering information is still very much in place. Citizens are still being invited to inform on their friends and neighbors’ email or conversations.
This is a problem. From the first day the “flag” email site was announced, its creation symbolically signaled that the Obama administration intended to do everything it could to promote its social policies and suppress all dissent. Some worried whether the creation of the site to inform on dissenters from the president’s policies was just a ploy to gather information about potential political enemies.
Lawmakers knew this. Even when the site was reported to have been removed, Sen. John Cornyn, Texas Republican, noted that “questions still remain about information that’s already been collected over the past few weeks.”

In 2009, the White House launched an effort to get people to snitch on those who expressed opposition to President Obama through a new official e-mail, flag@whitehouse.gov, and a web page on the official White House site. It didn’t quite last a fortnight, thanks to an outcry of anger over the idea that a President would be so petty and so paranoid as to need an official informant bureau in the White House. They dropped this about the same time that Obama finally dropped his war on Fox News, having lost on all fronts to control opinion.
Did they learn a lesson? Apparently not, or at least they learned the wrong lesson. The “flag” program is back, but this time it’s being run out of the Obama re-election campaign...

Mr. Moran joins a group of departing Democrats conceding what everyone knows: Obamacare is a train wreck. An airliner crash. A battleship aground on the reef. Pick your metaphor.
...“I’m afraid that the millennials, if you will,” Mr. Moran tells Washington’s WAMU-FM radio, “are less likely to sign up. I think they feel more independent. His analysis is spot on, but that’s small consolation. “I just don’t know how we’re going to [fix] it, frankly,” says Mr. Moran. “If we had a solution, I’d be telling the president right now.” Now he tells us.
Belated it is, but Mr. Moran’s assessment is a breath of fresh air in an environment where the Obama administration talks about “surges” in enrollments and tells “success” stories that don’t bear the weight of scrutiny. Obamacare was sold to the nation on a similar foundation of lies....
Fellow Democrats press Obama to approve Keystone, following environmental report
“Today's Environmental Impact Statement confirms what Alaskans already know -- there are ways to safely and responsibly diversify our domestic energy supply,” said Sen. Mark Begich, D-Alaska. “Move this project forward.”
Begich also said he will continue to “demand” that Obama approve the $7 billion pipeline project while reminding him that development in Alaska’s Arctic Ocean and National Petroleum Reserve is critical in securing the county’s energy independence from foreign countries.
He was joined Friday by Louisiana Democratic Sen. Mary Landrieu in calling on Obama to approve the project, proposed back in 2010.
“This new study underscores what has been said all along about Keystone XL Pipeline: It’s time to build,” Landrieu said.
Begich and Landrieu are in tough, 2014 re-election efforts in conservative-leaning, energy-producing states.

...The Tea Party opposes much of President Obama’s agenda, and to Mr. Schumer, that’s both a sin and a crime.
In a speech last week to the liberal Center for American Progress, the senior senator from New York said, “There are many things that can be done administratively by the IRS and other government agencies” to silence groups that obstruct Democratic policies....
The latest group harassed by the IRS might be the smallest in America; namely, conservatives in Hollywood. An organization known as Friends of Abe, named for Abraham Lincoln, is trying to get tax-exempt status. The IRS is doing what it can to scuttle the application and wants to see the organization’s membership list.
The actors, directors and writers who are Friends of Abe are wary of coming out of the closet where traditional values are often hidden in Hollywood. Nothing threatens a promising career in Tinseltown faster than exposure as a Republican or other conservative.
In a just world, the Center for American Progress, the 501(c)(3) nonprofit organization that hosted Mr. Schumer’s call for government harassment of conservatives groups, would get similar scrutiny....

On Wednesday, Mitch McConnell told Fox News' Megyn Kelly that the Obama administration is "initiating a new rule through the Treasury Department in the IRS to quiet the voices of outside groups." According to McConnell, the new rule would redefine what groups like the Tea Party could advocate, during a political campaign "to silence the voices of their critics going into this important fall election by using the Treasury Department regulations."
...McConnell's got it right. In the hands of a criminally partisan IRS "reference to a particular issue . . . distinguishing the candidate from others" is not only permission to, but an instruction to harass and deny 501 (c) (4) status to any group that opposes ObamaCare, amnesty, same-sex marriage, or any other issue dear to the president's heart. Far from creating a bright-line distinction, "distinguishing the candidate from others" sets no boundaries at all, giving one of Washington's most politicized, corrupt, and powerful agencies unfettered discretion to reward Obama's friends and punish his enemies.

...Actually, the problem wasn’t that there was too little involvement from the private sector; it’s that it didn’t belong in the federal government in the first place. But even apart from that, the site was built by the private sector, with the full cooperation of private insurers who hoped to score big off of a historic government mandate that forced Americans to participate in a command economy. The problem was that the people who command that economy are singularly unqualified for the job, as most if not all of them have done little but public-sector work for the majority of their lives. The incompetent management of this system began in the bid process and escalated throughout the project-management phase, and was obvious by the increasingly arbitrary ways in which regulations and statutes were applied and enforced.
That’s what is painful to Davis, who cheers government-controlled universal health care as the appetizer to his advice to Pelosi. Davis says it could have been accomplished through distributed authority in the private sector, but that’s never been the point of Democratic health-care policy. It’s always been about control and power, and dictating outcomes to insurers, providers, and consumers. We tried it, and now we see why the public sector should be limited to appropriate regulatory functions and law enforcement, and private economies left to voluntary association and the private sector.

They make citizens see Washington as an alien and hostile power.
Washington sees the disaffection. They read the polls, they know.
They call it rage. But it feels more like grief. Like the loss of something you never thought you'd lose, your sense of your country and your place in it, your rights in it.

Thank goodness we don’t have a Republican president! If we did, we would be in the midst of a constitutional crisis. Imagine this scenario: an American president announces that, rather than taking care that the laws be faithfully executed, as the Constitution requires, the federal government henceforth will enforce only those provisions of federal law with which he personally agrees. Not only that, if Congress declines to enact legislation that he demands, he will issue executive orders having the force of law as though such legislation were in effect. And if you oppose him, he will send the IRS to harass you and have his corrupt Department of Justice charge you with a bogus felony if he can come up with a pretext, or maybe even if he can’t.

More States Are Quietly Becoming Republican
The strength in state legislatures allowed Democrats to draw Republican voters into electoral ghettos which made it much easier for Democrats to hold the House. That has been reversed. Republican gains in the last twenty years in state legislatures means that the number of congressional districts drawn by Republicans has grown dramatically -- from 5 districts in 1991 to 98 districts in 2001, and now 193 districts in 2011 -- while the number of districts drawn by Democrats have shrunk, from 172 districts in 1991 to 135 districts in 2011 to only 44 districts today.
This means that the bedrock of political power in America (winning elections in Congress and state governments) is moving steadily to the Republican Party. As more states become Republican, a natural advantage in winning Senate elections will grow, and as and more and more legislative districts are controlled by Republicans, electoral districts for members of the House of Representatives and state legislatures are being drawn by Republicans.
In 2009, pundits wondered if the Republican Party would survive, but it is the Party of Obama that looks more and more like the real political dinosaur in America. If the Party of Obama is routed in 2014 and not only is the Senate lost, but more state legislative chambers and House districts are won by Republicans, the sea change that many of us have hoped for may be at last have arrived.

Effort to raise vehicle license fee dropped
...The California Road Repairs Act would have increased the vehicle license fee by 0.25 percent a year for four years, raising it from 0.65 percent to 1.65 percent of a vehicle's value.
The withdrawal of the proposal drew mixed reaction from motorists. Joan Armstrong, of San Jose, said an increase in the license fee would have added "hundreds of dollars" for her family's three cars....
The vehicle license fee has been controversial since 2003, when Gov. Gray Davis raised the fee and motorists rebelled. Arnold Schwarzenegger campaigned against the increase during his effort to recall Davis, and he quickly abolished the license fee increase upon taking office.

Federal consumer bureau data-mining hundreds of millions of consumer credit card accounts, mortgages

It was also learned at a Congressional hearing Tuesday that CFPB officials are working with the Federal Housing Finance Agency on a second data-mining effort, this one focused on the 53 million residential mortgages taken out by Americans since 1998.
The mortgage information is being compiled in a database that can be "reversed engineered" by hackers seeking information for identify theft, according to an expert cited during the hearing.
The revelations came in a hearing of the House Financial Services Committee, during which CFPB Director Richard Cordray was repeatedly pressed about federal officials rummaging around in the private financial affairs of millions of Americans.

Leaders of major labor unions are pushing back against proposed regulatory changes that could affect some union-sponsored health plans under ObamaCare, arguing the proposals do nothing to help workers suffering under the law.
In a letter to Senate Majority Leader Harry Reid, D-Nev., and House Minority Leader Nancy Pelosi, D-Calif., the presidents of two high-profile labor unions said they are "bitterly disappointed" with the administrations's proposed rules, The Hill reported.
Terry O'Sullivan, president of the Laborers’ International Union of North America, and D. Taylor, president of Unite Here said the administration has failed to address their concerns about union plans and that ObamaCare threatens to lower the standard of living for the working class.

Population Declining in States With Relatively High Dependence on Government
This reflects the wearing off of the effects of the big jump in government spending triggered by the 2009 stimulus package and a heartening, though limited, resurgence of the private sector as government spending has slowed....
The shale boom has obviously helped Texas, but it's far from the sole cause of its strength. Its economy is highly diversified, to the point that it's gaining high-tech jobs from Silicon Valley.
From September 2007 to November 2013, while the nation lost 1.8 million jobs, Texas gained 1.1 million. Texas' public policies -- low taxes, light regulation -- have clearly paid off.
Most Texans tell pollsters they're distressed about the direction of the nation -- understandably, since the Obama administration's policies are so different from their own.
But Texas's demographic numbers suggest that traditional American optimism and willingness to take risks are not altogether dead. They're alive and thriving just north of the Rio Grande.

Last year, despite support in both the Assembly and the Senate for nine of the ten points, the Assembly held the nine points hostage in favor of the abortion-expanding tenth point.
Ted Cruz Changes His Mind About Obamacare
In the new year, Americans would become “hooked on the subsidies, addicted to the sugar,” Cruz told a Tea Party gathering in his home state on August 19, according to the Texas Tribune. “If we get to January 1, this thing is here forever.” This belief was a main justification for the last-ditch campaign to fund the government if, and only if, Obamacare was defunded.
But on a conference call Wednesday afternoon, a month after Obamacare subsidies began flowing, Cruz told reporters that he no longer believes that January 1 was the deadline to stop Obamacare. "I believe we will repeal Obamacare," he said.
The reason Cruz thinks the law can still be repealed is that he and others had the high-profile fight to defund Obamacare in the first place. "I think we are seeing the fruits of the battle that so many millions of Americans engaged in last fall to stop Obamacare," Cruz said. "I think the direct result of that fight was to elevate the national debate about the harms that Obamacare has caused. And as a consequence, I think the terrain has changed, and I believe we will repeal Obamacare."
California’s Obamacare Scandal
Californians still have good cause to be concerned about their privacy.
Even a single crooked navigator could do significant harm to the public. That’s because when navigators sign consumers up for health insurance under the Affordable Care Act, they have access to lots of private information, including Social Security numbers, home addresses, and financial data — basically, everything on the wish list of identity thieves and fraudsters. Navigators also are likely to work with a population that is more vulnerable than average.
...Limited statistics released by Covered California — the state’s new health-insurance exchange — showed that one navigator has repeat forgery offenses — one in 1982, then another in 1994, with a burglary in between. Another had two forgery convictions in 1988, in addition to a domestic-violence charge a decade later. Another committed welfare fraud in 1999 and had shoplifted on at least two prior occasions. Since 2000, individuals now working as navigators have committed crimes including child abuse, battery, petty theft, and evading a police officer. At least seven navigators have multiple convictions. The information released covered only certified enrollment counselors, one of the three types of navigators working in California.

Obama turns authoritarian, rather than work with Congress
It was the speech of a clearly frustrated leader who has always been uncomfortable with the need to work with others to accomplish his ends.
He continues to talk as if he has tried his best to work with Congress only to be constantly rebuffed by Republicans, who just don’t share his heartfelt desire to solve the nation’s problems.
Even those who complain about the partisanship of Republican leaders know this isn’t even a half-truth. This is a president who doesn’t even work well with members of his own party, let alone those of the opposition party....
Words, as Mr. Carney has warned us, are just words and don’t really matter.
Actions do, though, and if Mr. Obama follows through on his threat to govern by phone and pen, to ignore Congress and to implicitly emulate the style of authoritarian governments whose leaders don’t have to worry about legislatures, checks and balances, and the separation of powers that have limited the ability of U.S. presidents to “get things done,” we are in for a rough couple of years.
He may have been delivering his speech last night to Congress, but it would have been better suited for an “Occupy” rally of class warriors.

We set up an early warning system in all of our offices for any suspicious characters or questions that seemed inappropriate. We did office-by-office training sessions on how to handle O’Keefers. We required a minimum of a weekly role play session with all staff with an organizer being an O’Keefe and walking each organizer through how to handle him or her.”
The same article reported that “Battleground sought to keep 10,000 volunteers from saying or doing anything that might play into O’Keefe’s hands.”

Francois said the Point Reyes National Seashore itself wouldn't exist if not for the multi-generational ranches and farms (including Drakes Bay), which have operated on the land for decades. These farms agreed with the government that the region's rich
agricultural heritage should be protected from development and worked cooperatively with federal officials to create the park.
"The Supreme Court needs to take this case, because the lower courts have abdicated their judicial responsibility by refusing to review the government's arbitrary actions," Francois said in a statement. "This case isn't just a challenge to the government's vendetta against the Drakes Bay Oyster farm, it's a fight to uphold our system of checks and balances and to make sure that bureaucracies aren't above the law."

However, there is nothing fuzzy about Obama’s policy of “Oblimination.”
Tuesday night, President Obama in his State of the Union address said, “Here are the results of your efforts: The lowest unemployment rate in over five years,” touting the “success” of his policies in reducing the unemployment rate down to 6.7%.
Concluding that this drop in the unemployment rate is a good development is not only false, but it is also outright mean to the millions of Americans who can’t find a job because of his failed economic policies.

Time for those media brows to furrow deeply again, as the Associated Press reports an important metric of future growth falling right off a cliff, on the eve of the State of the Union address:
Businesses cut back sharply on their orders for long-lasting manufactured goods in December with a key category that signals business investment plans falling by the biggest amount in five months.In the great airport lounge where America waits for Recovery to come trundling down the concourse with her suitcase full of jobs and prosperity, every flight status just flipped to “Delayed” again. Oh, well, might as well mosey over to the Starbucks and grab a frappucino while we wait for her. They take EBT cards, right?
Orders for durable goods fell 4.3 percent in December compared with November, when orders had risen 2.6 percent, the Commerce Department reported Tuesday....
There was widespread weakness in a number of categories including a 1.3 percent decline in demand for non-defense capital goods excluding aircraft. This category is viewed as a proxy for business investment plans.
Some of the December weakness probably reflected a temporary dip following November’s big jump which had been driven by businesses rushing to take advantage of expiring tax breaks.
The December decline came as a surprise to economists. The consensus view among economists was that orders would post a moderate rise reflecting what they believe is an improving outlook for U.S. manufacturers
...The danger zone would be for things to pick enough for the Federal Reserve to discontinue its bond-buying stimulus spending spree – which has been pumping a lot of money into Wall Street, in a process that would be denounced as “trickle-down economics” if it wasn’t authorized by a Democrat – but not enough to survive the resulting sugar crash. The notion of anyone talking about “recovery” when a stimulus program of large-scale federal bond-buying is still in effect seems dishonest to me, but that’s the world we live in....

The latest ABC News-Washington Post survey counts a majority of registered voters who disapprove of the way the White House has handled health care and the economy. Sixty-two percent say America is on the wrong track “moving forward,” as the cliche goes.
Given the Obamacare fiasco, rampant unemployment and no economic growth, how could it be otherwise? What ought to concern all the president’s men is how tarnished Mr. Obama’s reputation has become.
When Barack Obama took the oath of office on a chilly January day in 2009, he did so on a wave of joyous enthusiasm. Even those who did not share the enthusiasm could nevertheless feel it. Seventy-two percent of voters told ABC’s pollsters on that day that Mr. Obama “understands the problems of people like us.”
Fast-forward to 2014, and now 52 percent now say that he just doesn’t understand them at all. A mere 37 percent are confident now that Mr. Obama will make the right choices. America finds the man in the Oval Office to be arrogant, out of touch and out of his depth.

Does he intend to rip the nation apart?
We can expect President Obama’s big speech Tuesday night to be full of his usual class-warfare bloviation about the “lack of upward mobility” being the “defining problem of our time.” He wants more and bigger government, so he defines problems in a way that demands another federal solution.
...The United States has fallen in almost every ranking of economic freedom over the past decades. Government has ballooned, the regulatory burden has become onerous and property rights are precarious and insecure.
The Great Recession ended five years ago, but few feel the effect of an improved economy. These are the barriers to upward mobility, not the prosperity of entrepreneurs and investors.
If Mr. Obama really wants to make a difference, he’ll negotiate a truce in the war on poverty and the culture, and call in his State of the Union speech for a restoration of the freedoms that gave birth to the American dream. Only then can we hope to see morning in America again.

President Obama will unveil a slate of executive actions in his State of the Union address Tuesday just as questions about competency plague his White House.
...On the eve of Obama's address to Congress, the White House accused Republicans of overplaying the president's intentions.
“We're not saying this is an either/or proposition,” press secretary Jay Carney said of executive action versus new laws. “It's a both/and. It's reaching out to Congress and looking forward to the possibility of further bipartisan cooperation on big, medium and small issues.”
“The president should absolutely use the powers available to him and the unique authority that the office provides to move forward,” Obama's top spokesman added.
Some Republicans argue, however, that Obama's latest State of the Union pitch is just a rhetorical gimmick. They say Obama's address Tuesday is just the latest version of his “we can't wait” tour and other campaign-style messages employed to change the narrative in Washington.
“He can work with us to create opportunity and prosperity. Or he can issue press releases,” Brendan Buck, spokesman for Speaker John Boehner, R-Ohio, said of Obama. “That's the choice the president faces this year.”

Chuck Schumer, the Senate’s No. 3 Democrat, thinks the Internal Revenue Service hasn’t done enough to silence the Tea Party. He wants the White House and the IRS to “immediately redouble” efforts to shut down conservative political-action groups through tougher government oversight and enforcement.
The Tea Party opposes much of President Obama’s agenda, and to Mr. Schumer, that’s both a sin and a crime.
In a speech last week to the liberal Center for American Progress, the senior senator from New York said, “There are many things that can be done administratively by the IRS and other government agencies” to silence groups that obstruct Democratic policies....
Strengthening the IRS‘ ability to make trouble for conservatives in politics is a priority for Mr. Obama and Harry Reid, the leader of the Democratic majority in the Senate. They regard the IRS scandal not as a scandal, but as a starting point for suppressing enemies.
