The Ninth Circuit Protects Gun Rights and Stops Confiscation



Every now and then the Ninth Circuit Court of Appeals — arguably the nation’s most progressive federal circuit — can offer up a legal surprise. Yesterday, it gave us a legal shock, when a divided panel of its judges affirmed last year’s federal district-court injunction temporarily blocking enforcement of California’s confiscatory ban on so-called large-capacity magazines.

Under California law, any person who possesses a legally purchased magazine capable of holding more than ten rounds of ammunition must either remove the magazine from the state, sell it to a licensed firearm dealer, or hand it over to law enforcement. Those citizens who retained their magazines after the law went into effect risked a fine or up to one year’s imprisonment in county jail.

The district court’s 66-page opinion was a legal tour-de-force that not only dismantled California’s justifications for the ban, but also reiterated and reinforced the constitutional and historical basis for the right to keep and bear arms....

Look homeward, "change agents"



...There were no district-wide walkouts and nationwide protests when Broward County parents of special-needs students were laughed at during a school board meeting as they exposed how their children had been bullied, beaten and bitten by tormentors without consequences in 2016. Nor was there a massive uproar last fall when the district acknowledged a whopping 480 incidents of alleged sexual harassment and abuse in its schools.

As a famous Chicago community organizer once quipped, “Change is hard.” Selfies with gun control armbands is easy. Cleaning your own house, district and county is hard. Junkets to D.C. are easy. Digging through audits and public records is hard. Regurgitating Mad Libs-like talking points against the NRA and Second Amendment is easy.

Go back to class and look homeward, all you young “change agents.” The faultiest faults are near, not far.....

Unhappy New Year for California Gun Owners



While most of America was busy preparing to celebrate the New Year, gun owners in California were scrambling to lawfully purchase ammunition while they still could. Beginning January 1, all ammunition sales were required go through a California licensed dealer or licensed ammunition vendor.

This new requirement is one of two new ammunition laws that were passed by the California legislature or adopted by California voters in 2016. The law that took effect on January 1 will generally prohibit gun owners from bringing ammunition into the Golden State or from purchasing their ammunition online.

California adopted these new laws in spite of significant evidence that they would only burden law-abiding gun owners and do nothing to promote public safety. Most notably, the reporting of ammunition sales has already been tried -- and failed -- at the federal level....

On June 29 — two days before California’s “high capacity” magazine ban was set to take effect — U.S. District Judge Roger Benitez blocked the ban to prevent “otherwise law-abiding” citizens from being criminalized.



...Benitez ruled that the ban takes away Second Amendment rights “and amounts to the government taking people’s private property without compensation.”

According to ABC News, Benitez ruled, “If this injunction does not issue, hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw or dispossess one’s self of lawfully acquired property.”

And while the ban was approved by a majority of California voters, Benitez noted, “[The] constitution is a shield from the tyranny of the majority.”...
