Humboldt: Supes to use Measure Z funds to cover fire, airport security gaps

About $63,000 is being recommended by county staff to pay for a “critical emergency services gap” along the State Route 299 corridor area, which is not covered by the nearby fire districts in Blue Lake, Kneeland and Willow Creek. These three fire districts have been responding to this large area on a “goodwill” basis for several years, but are unable to collect any fees from them.

“These three fire districts are currently called upon to provide this service, funded only by revenue generated from within their districts,” a Feb. 26 letter from the Humboldt County Fire Chiefs Association to the board states. “This is not a sustainable or equitable system and a new structure needs to be put in place. These three fire districts have communicated to the county that they are no longer in a financial position to continue to provide this service without funding.”

The proposed $63,000 would only cover fire services for the remainder of the fiscal year, which ends on June 30.

Fifth District Supervisor Ryan Sundberg, who serves on the board’s Fire Services Committee with Fennell, said the majority of the service calls that districts receive in these uncovered areas are vehicle collisions and medical aid calls on SR 299.

“This is kind of bridge funding between now and the time we get the whole issue solved for Humboldt County for rural fire departments responding outside their district,” Sundberg said.

Over the past year, local marijuana growers and activists, led by the political action group California Cannabis Voice-Humboldt (CCVH), have worked hard to legitimize the industry — drafting legislation, packing the Board of Supervisors chambers and urging “farmers” to come out of the shadows and be regulated. So when law enforcement this week raided grow operations on Island Mountain, including at least one belonging to a member of the group, activists viewed it as a betrayal of their trust.

The identity of the growers and/or property owners targeted in the raids have yet to be disclosed....

Meanwhile, CCVH still hopes to get a countywide outdoor cultivation ordinance on the books before the year is out. Local environmental leaders have pushed back against the group’s agenda and methods, comparing the situation to allowing timber companies to write their own rulebook.

Yesterday’s multi-agency marijuana raid at Island Mountain involved people currently active in the political action group California Cannabis Voice-Humboldt (CCVH), the group’s executive director, Richard Marks, confirmed this morning.

Weed is littered across the agenda for today’s meeting of the Humboldt County Board of Supervisors, and during the morning session the board quibbled over two main issues: First was a letter of support for Assembly Bill 243, a piece of statewide legislation written by the North Coast’s own Assemblymember Jim Wood.

The bill, called the Marijuana Watershed Protection Act, passed the Assembly last month in May and is now being considered on the floor of the Senate. Wood has said his bill is aimed at addressing the environmental impacts of medical marijuana farms, in part by creating “a structure to tag permitted medical cannabis plants with a unique identifier for each plant.”...

Luke Bruner, the enthusiastic young co-founder and public figurehead of the political action group California Cannabis Voice Humboldt (CCVH), spent nearly two hours this afternoon outlining the major provisions in his group’s ambitious Land Use Ordinance to the Humboldt County Board of Supervisors. The document, more than a year in the making and now in its seventh draft, aims not only to bring Humboldt County’s rampaging marijuana industry into some semblance of order through a series of governmental regulations but also to serve as a template for regulation throughout rural California.

It’s the product of considerable effort and organization from a group few had heard of a year ago, and the task they undertook — trying to entice a profitable black market into the bonds of regulation and taxation on the one hand while, on the other, trying to convince the government to let an industry draft its own regulatory laws — could aptly be described as Herculean....

As the Outpost noted in a previous post, the proposed ordinance hinges on the addition of “cannabis” to the county’s definition of general agriculture. Once that change was in the books, Bruner explained, cannabis could be grown on any parcel in the county where general ag is currently allowed — including land zoned for timber production (TPZ). The exception would be within the Coastal Zone since the California Coastal Commission won’t allow it.

Humboldt County supervisors take on rising health insurance costs: County faces $1.4M in unexpected expenses

According to a county report, the approximately $303.7 million budget for the 2013-14 fiscal year was developed with the expectation that the California Public Employees' Retirement System, or CalPERS, would increase monthly health insurance rates by around 7.5 percent. Instead, the county's portion jumped from $425.30 to $550.20, or about 29.4 percent, for staff not with the Humboldt Deputy Sheriff's Organization.

The money adds up to $457,000 in unexpected costs to the General Fund and $934,000 to other county funds, totaling just under $1.4 million.

”The good news is that the County ended fiscal year 2012-13 with a $6.8 million General Fund balance,” county Public Information Officer Sean Quincey said in an email .

Pot growing ordinance back for discussion: Humboldt County supervisors look to address grows as land use issue

...Under the proposed ordinance, marijuana plants on properties less than one-half acre in size must be grown indoors, which would make the grow subject to other county building codes.

For properties that are between one-half acre and 5 acres, {Board chairman and 5th District Supervisor Ryan} Sundberg said owners would be allowed a maximum of five mature plants. {Currently 99} A county report states that marijuana grown in a greenhouse is considered an outdoor grow.

The overall canopy of both indoor and outdoor grows must be less than 50 square feet per property....

In May, Sundberg and 3rd District Supervisor Mark Lovelace, who make up the board's medical marijuana subcommittee, were tasked with revising the ordinance in two separate parts: small grows and large grows.

”We decided we would work on the small community nuisance issue first,” he said, adding that properties larger than 5 acres will be addressed after an ordinance for small grows is worked out....

A retired prosecutor has filed paperwork with the Humboldt County Elections Office announcing his intent to run for district attorney in 2014.

Arnold Klein, who retired from the Humboldt County District Attorney's Office in January 2012 at the age of 69, filed a candidate intention statement with the elections office on Monday, Elections Manager Kelly Sanders confirmed.

”This is something that allows candidates to go out and start raising money,” Sanders said of the intention statement, which is the first step toward forming candidate committees and fundraising.

Sanders said several incumbent candidates have also filed statements indicating their intention to seek re-election....

Sanders said 5th District Supervisor Ryan Sundberg and 4th District Supervisor Virginia Bass have both filed candidate intention statements indicating they plan to seek re-election next year. Humboldt County Harbor, Recreation and Conservation District Division 5 Commissioner Richard Marks has also filed paperwork indicating he intends to seek re-election in November of this year, Sanders said.

Sanders said the filing period for candidates to officially file a declaration of candidacy to seek election in November 2014 begins in March.

Board of Supervisors meeting reminder! Humboldt County Draft General Plan Update

On Monday, October 15th at 1:30 pm or as soon thereafter as the matter can be heard, the Board of Supervisors will hold a continued public hearing on the Humboldt County General Plan Update - Planning Commission Approved Draft Plan (Draft Plan). The purpose of this meeting is to continue Board deliberation of Chapter 5 (Infrastructure) and begin deliberation on Chapter 7, Circulation, and Chapter 9, Economic Development. The hearing will be held in the Board of Supervisors' Chamber, Humboldt County Courthouse, 825 Fifth Street, Eureka, California, (wheelchair access is available from the 829 Fourth Street entrance). A sign-up list for speakers will be provided outside of the Board Chambers for those persons wishing to present public testimony on the Draft Plan. Kevin Hoover: Public Involvement, So Crucial And So Stupidly Disregarded

There’s something not happening here. What it is ain’t exactly clear. That is, if it’s anything at all.

As you know from the “Then and Now” series of photos in the Eye’s pages, Arcata is always changing in ways large and small, blatant and subtle, but also visual and invisible.

Over the last several years, we’ve had a fall-off in opinion submissions at the paper. We used to have far more letters to the editor than we could fit into two or even three “Opinion” pages. These days, we can easily get by with one, and some weeks there aren’t even any letters to the editor other than cranks and identity-theft sexpots. Maybe we’re satisfying our expressive needs on Facebook, saying “LOL!!!!!!!!” to pics of kittens in hampers, or anonymously calling people Nazis on blogs, I don’t know.

Further, we, as a town, didn’t manage to generate any ballot choices for City Council other than the three incumbents and any possible write-ins (Valerie Rose-Campbell is trying, but even if she succeeds, she’ll be at a structural disadvantage).... Humboldt County General Plan Discussions

The general plan update -- which defines acceptable land uses in each area of the county for future development -- made its official transition from the county planning commission to the board on June 12. On Monday, the supervisors will hold a continued discussion on the land use element, including agricultural resources, forest resources, public lands and land use classifications. Infrastructure and telecommunications will be discussed as part of chapters five and six.

...once the hour or so of public comment was aired, featuring the usual line-up heavy with the developer and real estate lobby, the meeting swerved right off agenda; Sundberg led the way with charges that the document was just too big and unwieldy to digest and then justify to the public.

“At the end of this, we’re just going to get sued,” he said. “At the end we’re going to find out we can’t even afford to implement it....”

Long a champion of the plan update process before assuming his seat in 2008, Supervisor Mark Lovelace was visibly shaken by the turn of events and lashed out in response.

“None of us has any basis to say we can’t hack it,” he said. “I’m sorry, but this is the job we signed on to…the idea of even beginning to throw away twelve years of process is just not acceptable.”

Sundberg fired back, telling Lovelace he objected to being chastised.

“I think it’s borderline rude to say we’re not willing to hack it,” Sundberg said. “I’m asking the question of whether we can pare [the General Plan] down to where it’s understandable.”

Coming back to the center of the dais, Supervisor Virginia Bass said the conversation underway was one that should have happened some time ago.

“It’s something I have not had the guts to say,” she said. “I want to thank Ryan for bringing it forward.”

Discussion at Monday's meeting on Humboldt County's general plan update has raised concerns that there's movement to scrap the process to date, but supervisors said Tuesday that's not necessarily the case.

The supervisors met Monday to discuss the fourth, fifth and sixth chapters of the county's draft general plan update. The general plan update -- which defines acceptable land uses in each area of the county for future development -- has been in the works for more than a decade and transitioned from the county planning commission to the supervisors on June 12.

Fifth District Supervisor Ryan Sundberg said he commented on how the plan is a large and confusing document that could lead to potential lawsuits. He said he wasn't proposing the board start over on the plan, but that the material be presented in a more easily understandable format.

As part of the supervisors' decision, the new reports will be drafted starting with chapters five and six of the update, which covers community infrastructure and services, and telecommunications. Supervisors to appoint McKinleyville Municipal Advisory Committee members; three board-appointed seats up for grabs

Applicants include communications technician David Christian, file clerk Eleanor Sullivan, U.S. Coast Guard helicopter pilot Bernie Garrigan, contractor Tim Hooven, engineering project manager Patrick Barsanti, school bus driver Kathleen Christopher, Caltrans associate right-of-way agent Nancy Hueske, Caltrans senior right-of-way agent Leota Lovelace, Realtor Kevin Dreyer, retired McKinleyville resident Ben Shepherd, multiple business owner Kevin Jenkins and Realtor Terry Roberts.

The committee will have seven voting members and one non-voting member. The voting members of the board will be include three people chosen by the supervisors as a whole, three people chosen by 5th District Supervisor Ryan Sundberg -- who represents McKinleyville -- and one person chosen by the McKinleyville Community Services District.

The McKinleyville Community Services District has already appointed MCSD Director Helen Edwards as its voting member and MCSD General Manager Norman Shopay as the non-voting member of the committee, according to the county staff report.

No supervisors meetings until Aug. 14

Community honors Supervisor Jimmy Smith at his last meeting

◼ First District Supervisor Jimmy Smith received numerous accolades this morning during the Humboldt County Board of Supervisors meeting in honor of his service. - The Times-Standard

Smith spent the first two hours of the meeting receiving more than 15 plaques and presentations from government officials and organizations. Congressman Mike Thompson gave a presentation by way of video from Washington, D.C., thanking Smith for his mentorship.

”You will always be one of my best friends,” Thompson said.

Assemblyman Wesley Chesbro and a representative from Sen. Noreen Evans' office gave in-person presentations.

”You care deeply and it's not easy to do this work when you have the kind of heart you have,” Chesbro said to Smith.

Representatives from the U.S. Department of Fish and Game, the local American Cancer Society, the Ferndale Chamber of Commerce, Pacific Gas and Electric Company, the Eureka City Council, the Greater Eureka Chamber of Commerce, the North Coast Integrated Regional Water Management Plan board, the Humboldt Bay Harbor, Recreation and Conservation District, county Veterans Service Office and representatives of supervisors in Sonoma, Mendocino and Trinity counties all spoke about Smith.

Jacque Smith, Jimmy Smith's wife of 44 years, addressed the board and her husband. She said ever since her husband was diagnosed with pancreatic lymphoma in 1992 -- a disease he beat -- he's been on a mission to serve the community. Smith now faces another battle with lymphoma and will be stepping down from office on Aug. 3 after more than a decade of service.

Additional speakers included Sheriff Mike Downey, Public Works Director Tom Mattson, Registrar of Voters Carolyn Crnich, Chief Probation Officer Bill Damiano, Assemblyman Wesley Chesbro field representative John Woolley and 1st District Supervisor-elect Rex Bohn. Bohn was recently appointed by the governor to take over the rest of Smith's term.

Each of the supervisors took the opportunity to thank Smith for his service, using the words “mentor,” “gentleman,” “friend” and other terms of endearment to describe Smith.
Smith thanked all the presenters and more than 20 public speakers for their kind words. He thanked each of the supervisors for their work and support during this most recent hurdle in his life.

”I'm so honored to be a little part of your lives,” Smith said.

Bohn appointed as interim supervisor

Bohn will fill the seat vacated by Supervisor Jimmy Smith, who will step down Aug. 3 to focus on treating his lymphoma.

Supervisors vote to look at amending urgency ordinance; Supervisor Jimmy Smith submits resignation letter to board

◼ While the supervisors said they're not in support of seeing the courthouse grounds turned into “a private living room” again, Lovelace, 5th District Supervisor Ryan Sundberg and 4th District Supervisor Virginia Bass agreed the urgency ordinance should be changed to allow people to protest at night and hold candlelight vigils.

An urgency ordinance that restricts protest activities at the Humboldt County Courthouse might be amended after the Board of Supervisors voted Tuesday to have staff look at alterations.

Currently, the urgency ordinance restricts protest activities between 9:30 p.m. and 6 a.m., prohibits people from erecting structures or securing items to county property, prohibits camping on the courthouse grounds, prohibits obstructing access or interfering with the passage of others and more. The ordinance was passed in March in response to complaints about the activities of the Occupy group in front of the courthouse....

During the afternoon session of the meeting, the board officially received Smith's resignation letter. Smith is resigning effective Aug. 3 so he can rest while undergoing treatments for lymphoma -- a type of cancer that attacks white blood cells called lymphocytes.

An emotional Smith read the resignation letter aloud, struggling to get through the first few sentences. Smith, who has served on the board for 12 years, sent a letter to Gov. Jerry Brown asking that supervisor-elect Rex Bohn take his place when he steps down. The governor is responsible for appointing someone to fill the vacant supervisorial seat.

The board expressed gratitude for Smith's leadership, guidance and knowledge. The supervisors voted unanimously to send a letter to the governor seconding Smith's request to appoint Bohn to the seat. Bohn and Smith's wife were in the audience to support Smith.

Smith said he'll be working closely with Bohn and the board to try to make the change as seamless as possible.

Twelve other Republicans had a combined total of 880,000. Other Dems had a combined 260,000; minor party candidates had 150,000.

US HR, 2nd CD: Huffman (D) had 37.3%, Roberts 15.3% (in our County 18.5%), other 47.4%.
After Roberts it was Solomon, Lawson, Adams.

Voter turnout: Trinity 47.4%, Del Norte 40.8%, Sonoma 37%, Marin 35.4%, Humboldt 33.4%, Mendocino 28.4%. Sonoma County had far and away the largest number of voters, about 250M to Marin's 146M
