If Justice Breyer is laughing at the administration this early in the game, Team Obama may be in trouble.

Things did no not look very good for President Obama and the Democratic Party’s Obamacare law. Justice Stephen Breyer, one of four Democratic appointees to the Supreme Court, laughed at solicitor general Donald Verrilli for repeatedly using the phrase “tax penalty” to describe what you must pay if you do not buy or otherwise obtain health insurance by 2015. - Don Surber/Daily Mail

I am of two minds as to how this will play for Obama. Losing the case may help his re-election chances as he can say he gave it the old college try. Then again, losing Obamacare would wipe out his domestic policy achievements. Winning the case would allow him to say, see, I was right. But winning the case might cost him the election as Americans vote to throw the law out.

How is that for covering all the bases?
