IT director who raised questions about Zimmerman case is fired

An employee of the Florida State Attorney's Office who testified that prosecutors withheld evidence from George Zimmerman's defense team has been fired. - CNN

Kruidbos testified before Zimmerman's trial began that Martin's cell phone contained images of Martin blowing smoke, images of marijuana and deleted text messages regarding a transaction for a firearm and that those images had not been given to Zimmerman's defense team.

He received the termination letter, dated July 11, on Friday, the same day jurors began deliberating Zimmerman's case. The letter states: "It has come to our attention that you violated numerous State Attorney's Office (SAO) policies and procedures and have engaged in deliberate misconduct that is especially egregious in light of your position."

...Kruidbos said that, when he printed a 900-page Florida Department of Law Enforcement report from Martin's cell phone in late 2012 or early 2013, he noticed information was missing.

Concerned that attorneys did not have all the information they needed to prepare the case, he said, he reported his concerns to a State Attorney's Office investigator and later to prosecutor Bernie de la Rionda.

Kruidbos said he generated a report that was more than three times the size of the one that had been handed over.

For example, Kruidbos said that 2,958 photos were in the report given to the defense but that his report contained 4,275 photos....

Through his attorney, Wesley White, Kruidbos informed Zimmerman's defense team that the information existed....

...the defense said Kruidbos' testimony supports its claim that the state violated the rules of discovery....

(defense lawyer Mark) O'Mara said he learned about the missing information months after he was to have received it. "The only way that we really found out about it ... and the only way that we really found out about the intensity of the failure to give us information was when a person from their own office, a whistle-blower, came forward and said, 'I gave them that information in the middle to end of January' and we didn't get it until June 4th."

The last time I gave this address was back in 2009 when President Obama and the Democrats in charge of Congress were moving forward with their own go-it-alone plan for American health care reform.

Back then I warned that if Congress and the Administration messed this up, each and every one of us would pay for their mistakes, as would generations to come.

And, boy, are we paying for it.

All across the country health insurance rates are skyrocketing. Employees are losing coverage through their employers. Families are struggling to cope with higher costs and less choice. Businesses aren’t hiring full-time employees. (Scroll down for video of these complete remarks.)

Generally if it comes from Washington and it sounds too good to be true, it is.

No one likes to be right when what’s happening is affecting so many people in a negative way. The American people saw this coming, it’s a shame the President didn’t see it and didn’t listen.

It’s time to admit that this partisan experiment in government-run health care is failing. To get better they will have to acknowledge the problem.

Just last week, the Obama Administration was forced to admit that one of the key pieces of the health care law just isn’t working. The Administration can’t get it ready.

In an attempt to push the most economically crushing and burdensome regulations past the 2014 election, President Obama decided he had the authority to waive the employer mandate because he knows that it’s a political liability.

The delay will likely force even more people to either enroll on the exchanges, or be taxed if they don’t. This will likely increase the overall cost of this bill to the taxpayer, making it even more unaffordable.

Where did he find this authority to pick and choose what parts of the law he’ll put in place and when? Republicans and Democrats alike are asking how the Administration can possibly justify this decision.

The real answer is after 20,000 pages and still adding new regulations, and over 150 new bureaucratic agencies, boards, and programs, they still haven’t figured out what is in the law, or how to make the law work, which is why we need to permanently delay implementation of the law.

It appears that some Democrats want the health care train to wreck so we would be forced in to universal, single-payer, government-run, one-size-fits-all health care.

George Zimmerman is innocent. The evidence clearly shows this. Yet the liberal media have already convicted him in the court of public opinion. From the outset, liberal media outlets — CNN, MSNBC, NPR, CBS, ABC, NBC, the Huffington Post, The New York Times and The Washington Post — put forth one seminal narrative: The shooting of 17-year-old Trayvon Martin was a flagrant example of white racism against blacks. Modern-day Sanford, Fla., was transformed into 1960s Selma, Ala. Mr. Zimmerman has been turned into the poster child of a more subtle and polished, but revived Ku Klux Klan. For example, the audiotape of Mr. Zimmerman’s call to a 911 dispatcher on the night of the shooting was deliberately edited by NBC in a pathetic attempt to portray him as a vile racist bent on violence.

The entire mainstream media narrative, however, is based on lies.... If — and I stress if — there are race riots following the Zimmerman trial, then Mr. Obama and his media allies will have blood on their hands. They have smeared an innocent man, fanned the dangerous fires of racial division and hijacked a police investigation in order to pursue a political agenda of black victimology. The Obama administration claims it wants to ensure that the rank political abuse perpetrated by the Internal Revenue Service is never repeated. Ask Donald McGahn how that's going.

Mr. McGahn is a Republican appointee to the Federal Election Commission, an agency with every bit as much potential for partisan meddling as the IRS. Due to leave the agency soon, Mr. McGahn's parting gift is a campaign to rein in an out-of-control FEC bureaucracy. But the left is fighting that oversight and is determined to keep power in the hands of unaccountable staff.

...over the years staff have come to ignore the law, and routinely initiate their own inquiries—often on little more than accusations they find on blogs or Facebook FB +0.39% . For a sense of how these investigations can go off the rails, consider that Lois Lerner—before serving as the center of today's IRS scandal—was the senior enforcement officer at the FEC. A Christian Coalition lawyer has testified that during a (sanctioned) FEC investigation in the 1990s—in addition to generating endless subpoenas, depositions and document requests, Ms. Lerner's staff demanded to know what Coalition members discussed at their prayer meetings and what churches they belonged to. Once staff gets rolling, there is little to stop them.

More troubling to some FEC commissioners has been the staff's unsanctioned and growing ties to the Obama Justice Department. In September 2011, Tony Herman was named FEC general counsel. Mr. Herman in early 2012 brought in Dan Petalas, a Justice prosecutor, as head of the agency's enforcement section. FECA is clear that a bipartisan majority of commissioners must vote to report unlawful conduct to law enforcement. Yet FEC staff have increasingly been sending agency content to Justice without informing the commission.

Janet Napolitano, the U.S. secretary of Homeland Security and former governor of Arizona, is being named as the next president of the University of California system, in an unusual choice that brings a national-level politician to a position usually held by an academic. Her appointment also means the 10-campus system will be headed by a woman for the first time in its 145-year history.

Napolitano’s nomination by a committee of UC regents came after a secretive process that insiders said focused on her early as a high-profile, although untraditional, candidate who has led large public agencies and shown a strong interest in improving education.

UC officials believe that her Cabinet experiences –- which include helping to lead responses to hurricanes and tornadoes and overseeing some anti-terrorism measures -- will help UC administer its federal energy and nuclear weapons labs and aid its federally funded research in medicine and other areas.

The White House, in a classic political pump fake, issued a report this week claiming amnesty would stimulate the economy (though Obama never campaigned on that). No, the millions of new votes for future Schumers and Obamas will not rejuvenate American business. And no, Schumer's warning that GOP is "going to be a minority party for a generation" by opposing amnesty and lose the less than 9% of the electorate that constitutes the Hispanic vote is not to be taken seriously.

One thing that is incontrovertible about Obamacare — its brief history has been nothing if not dramatic. The plot is full of twist, turns, subterfuge, and villainy. As time goes on, the drama builds. How will this story end? Will it implode on itself? If it does, what happens then?

...It is hard to think of any government entitlement program being repealed ever. On the other hand, Obamacare is so badly conceived and designed, so internally inconsistent and hare-brained, that it is impossible to imagine how it will ever come anywhere close to being workable. The authors of Obamacare behaved as though a complete overhaul of one-sixth of the economy was no more complicated than changing a light bulb. Obamacare is naively ambitious beyond all imagining. This time the government may have bitten off more than it can chew.

Many observers believe the law’s architects always knew it could not work. Obamacare could just be a way station on the road to a more complete takeover of the health care industry such as the so-called “single payer” idea. Statists like Obama want the government to have total responsibility for the citizenry’s health.

It could well be that Obama, Pelosi, and Harry Reid knew from the beginning that Obamacare was doomed. After the inevitable catastrophe they can then say that a partial takeover was not successful but a complete takeover would be.

Will voters buy that line of reasoning? It’s another part of the suspense that will keep many of us on the edges of our seats....

Lois Lerner is a nasty piece of work, and one aspect of her arrogance could well be her undoing. She enjoyed wielding her power so much that she boasted about it, and in doing so in a 2011 interview with Business Week, she conceded a point that could be used to prove criminal culpability. - Thomas Lifson/American Thinker

Patrick Frey, who writes Patterico's Pontifications, uncovered the incriminating crowing:
A reader sends a very interesting tidbit buried in a ◼ November 17, 2011 Businessweek.com article about the IRS and not-for-profit universities. The article is about the IRS making inquiries into "whether schools improperly claimed tax-exempt status for taxable businesses." At the end of the article is this fascinating quote:
Lois Lerner, the IRS's director of tax-exempt organizations who is overseeing the investigation, says many schools are rethinking how and what they report to the government. Receiving a thick questionnaire from the IRS, she says, is a "behavior changer."
Frey provides a timeline, noting the bragging took place months after the initiation of the targeting of conservatives and tea parties. Ed Morrissey explains the implication in the ◼ Fiscal Times:
The targeting of conservative groups by the tax-exempt unit Lerner ran also used the "thick questionnaire" tactic, which Lerner brags is a form of intimidation. An entertaining timeline of the IRS targeting scandal compiled by Freedom Works, which supports and trains Tea Party activists and groups, shows Lerner found out about the targeting by June 27, 2011 at the latest, and had initiated an audit of the office and its "be on the lookout" (BOLO) list used for the targeting.

That resulted in a broader BOLO being put into use, and five months later, Lerner is bragging about the "behavior changer" effect of IRS demands for extensive information. Targeting continued well into 2013, and most of the groups that applied for tax-exempt status dropped those requests, or never received approval.

Disorder: Judge Recesses Zimmerman Trial, Excludes Damning Evidence

The forensic expert testified that he recovered multiple conversations between Trayvon Martin and specific family members and friends discussing multi-round street fights and schoolyard fights in which Trayvon Martin had participated. Martin’s half-brother, Demetrius Martin, even asked Trayvon when he would teach him how to fight. Trayvon Martin’s family appeared to know Trayvon was a street fighter.

Most troubling, Conner found multiple conversations — between four and six — where Trayvon discussed attempting to buy black-market guns.

The guns Martin discussed acquiring included a Smith & Wesson Sigma pistol and a .38 Special revolver. One conversation showed Martin trying to sell a .22 revolver, suggesting he was already in possession of it.

One of the participants in one of the gun conversations was a Fulton, possibly a relative on his mother’s side. All of these conversations took place immediately in the days and weeks before Trayvon Martin left Miami for Sanford.

The reason these conversations were hidden until recently is that the deleted texts were created by a password-protected hidden app designed to beat police surveillance by hiding data and data types as different kinds of files than what the police would be looking for.

The key facts in this development:

Trayvon Martin’s phone was password-protected. The password protection starts automatically after being left unattended for a certain amount of time.
The “stealth” app designed to further conceal Trayvon’s conversations about weapons, fighting, drugs, and pornography had an additional layer of password protection. He had to log into the phone first, and then to this app to access these conversations or delete them.
There were thousands of messages, texts, photos, Tweets, Facebook posts, and other bits of evidence hidden this way.

People who participated in these conversations are all documented by screen name, real name, phone number, social media personas, etc. They are all easily identified and could be deposed – if the defense is given time to do so.

The state hid this evidence until right before the beginning of the trial, when the prosecution’s Wesley White came forward to present testimony that the state was hiding and may have destroyed evidence. The defense has had no time to recover this data and to depose every witness.

This led to the showdown between incredulous defense attorney Don West, who can’t believe what he’s hearing, and Judge Debra Nelson, who puts the court in recess and exits — as the defense is still trying to talk to her.

Documents published online Wednesday by a conservative watchdog group show that the Community Relations Service, an arm of the U.S. Justice Department, spent taxpayer dollars to help organize and implement plans for the initial string of rallies in Sanford, Florida following the 2012 shooting death of Trayvon Martin.

Bradley Manning downloaded hundreds of thousands of documents from a classified computer network and gave them to WikiLeaks, the anti-government secrecy group. All departments and agencies involved in the program must closely track their employees’ online activities. If you still, for some reason, need proof that racism in today’s America is largely a liberal mind game, watch ten minutes of the George Zimmerman trial.

This farce of jurisprudence would never have occurred without leading “liberals” like Al Sharpton and his mainstream media buddies beating the drums endlessly for an indictment in a case the local Florida authorities never wanted to try (and for good reason).

Barack Obama helped out too, injecting the presidency (and race) in an unfortunate, but minor regional death by saying “If I had a son, he’d look just like Trayvon.”

I guess all black people look alike to Obama who, unlike Trayvon, attended the most exclusive private school in Hawaii followed by Occidental, Columbia and Harvard in that order. No such luck for Trayvon and, most likely, not much more had he lived. He wasn’t exactly an honor student and evidently dabbled in petty crime. But he did share something with the president, an attraction for cannibis sativa.

Whatever his or the president’s proclivities, this trial should never have happened. As we now know, with the prosecution’s case wrapped, not only is there no evidence to prove Zimmerman guilty beyond a reasonable doubt, there’s virtually no evidence to prove him guilty at all. Farce indeed.

He avoided public remarks on several matters seen as more pressing, such as turmoil in Egypt and the wider Middle East, faltering efforts to reform immigration in the U.S. and the rocky implementation of ObamaCare. Instead the president spoke to a small group of reporters about his efforts to improve databases and make government more efficient.

“We’re working to make huge swaths of your government more transparent and more accountable than ever before,” Obama said at the White House.

Even to the most loyal Obama supporters, the move seemed irrelevant, even odd.

He was shot to death Jan. 29 when gunmen intercepted his patrol car and opened fire. A bodyguard was also killed.

In the new excerpts, he explained his motivation for revealing the information. "I don't want to live in a world where everything that I say, everything I do, everyone I talk to, every expression of creativity or love or friendship is recorded," he said. "And that's not something I'm willing to support, it's not something I'm willing to build and it's not something I'm willing to live under."

He also insisted he had continued with his job while waiting for political leaders to rein in what he decribed as "government excesses".

But, he said, "as I've watched I've seen that's not occuring, and in fact we're compounding the excesses of prior governments and making it worse and more invasive. And no one is really standing to stop it."

On Friday, the Obama administration dropped another health care implementation bombshell.

In a 606-page regulation, issued the Friday after July 4, the administration announced that income and employment verification in the state-run exchanges in 2014 will be based on the “honor system.” That is, the state exchanges will not be required to secure independent verification of the household incomes of the applicants, nor will they have to track down whether or not applicants were offered qualified coverage by their employers. On both counts, the state exchanges can simply accept whatever is claimed by the applicants as accurate, and then pay out subsidies accordingly.

This announcement is another indicator—as if we needed one—of the complete fiasco that is Obamacare implementation.

The Obama administration announced Friday that it would significantly scale back the health law’s requirements that new insurance marketplaces verify consumers’ income and health insurance status.

Instead, the federal government will rely more heavily on consumers’ self-reported information until at least 2015, when it plans to have stronger verification systems in place.

(Roughly translated: They’ll pretty much believe anything you tell them so as to get as many people dependent on government handouts as possible. [See: food stamps (SNAP)].

Bloomberg News ◼ explains how financially troubled cities are looking to dump retirees into those train-wreck ObamaCare public exchanges:
With U.S. cities facing rising benefit costs and billions of dollars in unfunded liabilities, more municipalities will consider moving retirees off city rolls and into the exchanges, even if they continue to subsidize the coverage, said Neil Bomberg, a program director at the National League of Cities inWashington.

“Cities and towns will be looking at ways to reduce those costs, and the exchanges may provide a very viable mechanism,” Bomberg said in an interview.

Coverage for about 7 million people expected to enroll in health exchanges next year will cost U.S. taxpayers about $26 billion, the Congressional Budget Office says. That figure nearly doubles a year later, and exchange coverage is expected to total $1.1 trillion through 2023. A spokeswoman for the agency, Deborah Kilroe, said in an e-mail that it has no estimate of how many people in exchanges will be retirees....
The worse the system malfunctions, the more it will cost… and the more politically difficult serious reform will become… until the long-awaited day arrives that ObamaCare can be pronounced an utter failure, not by the critics who were right all along, but by the former ObamaCare boosters who will force single-payer nationalized health care upon us. The black hole forming at the heart of ObamaCare was the true purpose of the program all along.
