Twitter Doesn't Have To Live by the First Amendment, But @Nero Shows It Should



Earlier today, Twitter briefly suspended the account of Milo Yiannopoulos. Almost immediately, Twitter erupted in protest, with the hashtag #FreeMilo trending. His account was restored less than an hour later, but no explanation was ever provided.

This isn’t the first time Twitter has been suspected of censorship against conservatives, nor will it be the last. Twitter is far from alone: Facebook has been embroiled in scandal about censorship for weeks, while controversy on Reddit recently erupted in the wake of the Orlando shooting. This raises important questions about the differences between the legality of censorship, and the appropriateness of censorship....

With more than 300 million active users, Twitter’s user base has grown to nearly the same size as the population of the United States. Twitter, by some perspectives, has grown to be its own quasi-state. It is an entity that is used for sharing ideas and news in real time, which users rely on daily. When Twitter censors the views of Yiannopoulos and other individuals without cause or adherence to its rules, it erodes the foundation of, and destroys faith in, the validity of its rules and the content available through its service.

As an American company, Twitter ought to be promoting the same values of expression that America is founded upon, even if it is not required to. Twitter, by its very nature, is an extension of the marketplace of ideas. It should make every effort to promote and encourage it, not tear it down.

(T)he roots of the issue, Politico reports, stem from Presidential Policy Directive 22, an Obama administration decision that apparently gives the Secret Service the task of “access control” to the political conventions. Another report from USA Today indicated that Obama has issued 19 such “policy directives” (PPDs) without disclosing them to the public.



According to a Politico article published last month, journalists wanting to attend the Republican and Democratic political conventions this summer will have to submit to a new credentialing process that includes background checks conducted by the Secret Service.

Ironically, the roots of the issue, Politico reports, stem from Presidential Policy Directive 22, an Obama administration decision that apparently gives the Secret Service the task of “access control” to the political conventions. Another report from USA Today indicated that Obama has issued 19 such “policy directives” (PPDs) without disclosing them to the public.

The USA Today article quotes a political scientist and former advisor to Congress as stating PPDs “have the same legal force as an executive order, forming a body of largely secret law.” Nevertheless, executive orders must be published in the Federal Register. “PPDs are not," the advisor said. "It is a kind of secret law. People have to obey it. But it's a directive that can allocate money, direct people or take a course of action."

The media, needless to say, are incensed. A piece in the Daily Beast – using a metaphor that we consider especially amusing – characterizes the Washington press establishment as “up in arms.” That article even suggests that the Secret Service, having been “tarnished” by “aggressive investigative reporting,” may abuse its newly-conferred authority to settle the score.

Journalists cited by the Beast fault the “inscrutable security screening process for which there are no plainly established criteria, and from which there is no appeal,” as well as the idea that government is now exercising discretion over “who can and can’t be a journalist.”

“I don’t think the First Amendment allows that,” one journalist huffs. Concerns have also been raised that arrests arising from what the journalists claim is prior First Amendment activity might be enough to exclude them. Some are even floating the idea of “boycotting” the vetting process for credentials en masse.

Now that big media is feeling the indignity and insecurity of submitting their rights to the whims of an opaque and seemingly arbitrary bureaucratic screening process, we can only say, “Welcome to the club ... It serves you right.”

White House memo has had 'chilling effect' on release of documents to public



Launching a two-day hearing on the Freedom of Information Act (FOIA), Rep. Jason Chaffetz (R-Utah) blasted an email that directs federal agencies to consult with President Obama’s general counsel following any document request that could involve the White House.

“If you’ve got the yahoos at the White House having to review every document that falls under FOIA,” Chaffetz said. “This is the heart of the backlog.”

The memo, dated April 2009, applies to any documents that may have “White House equities.” Chaffetz suggested the memo is being used as an excuse to delay the release of documents.
“No, no, no, don’t fulfill the FOIA request,” Chaffetz said of the memo. “Send it here to the White House. We have equities! The White House equities!”

Rep. Jim Jordan (R-Ohio) said the memo has made federal employees fearful of crossing the White House.

MRC's Bozell: News Media Have Become 'Radicalized' and 'Marginalized'

Both MRC's Bozell and The Hill's Lauren Ashburn agreed that the media were too infatuated with government to act as an effective watchdog. But when Ashburn disagreed that journalists were ignoring liberal scandals, pointing to recent coverage of the Clinton Foundation scandal, Bozell called that "nonsense."
They have not gotten to the bottom of a single one of the Obama scandals....Look at the IRS, look at Benghazi, look at the VA, look at so many scandals -- they've been dropped. This one, this Clinton one, will be dropped as well....

...Yeah, isn't it incredible that their response to being marginalized is to be even more marginalized. They've become so radicalized. We've seen something in the last two years that I frankly hadn't seen before: This -- since 2008, I should say -- this commitment, this deliberate commitment not to report news if it harms the narrative of the left. This is not one example, this is not two examples, I can give you 20 examples. As a matter of fact, you and I have talked about this many times on your show. Either you support free speech — all of it — or you don’t

Following the horrific attacks at the Charlie Hebdo offices, in which Islamic terrorists executed journalists who published satirical cartoons critical of Islam, the West reacted with a widespread show of solidarity.

A Twitter hashtag, #JeSuisCharlie now is the most tweeted of all time and signified that, no matter how one feels about radical Islam, all can agree that speech should be supported and protected. Sunday’s “unity rally” in Paris, with a record-setting 3.7 million people in attendance, and dozens of world leaders marching together, overflowed with messages in support of free speech.

But the uncomfortable sleeper issue few wish to discuss is that, for all the images of photogenic Europeans on street corners holding “Je Suis Charlie” signs, or of Angela Merkel and David Cameron huddled together, Europe long ago abandoned any pretense as being a bastion of free speech.

The birthplace of the Enlightenment began to allow leftist notions of what is acceptable speech to dictate what is permissible speech....

And, only days later, liberals in the United States already are beginning to backpedal, noting civilized speech has “limits” and must be used “responsibly,” failing to realize that placing restrictions on free speech is, well, no free speech at all.

Reflecting on the tragedy, David Cameron reassured that Britain will “never give up” on freedom of speech — a curious remark, considering the United Kingdom boasts, for instance, the Public Order Act, a dangerous law banning “abusive” speech, which critics say has strangled free speech...

The West must make up its mind. Either it upholds free speech across the board or it abandons our most fundamental value and capitulates to a pattern of brutal censorship and inconsistent, irrational application.

We either practice #JeSuisCharlie or we do not.

Is the West, is America, is France itself, the land of Voltaire and he who is (although apocryphally) credited as proclaiming: “I disapprove of what you say but will defend to the death your right to say it” truly willing to stand by this noble ideal?

Scaling back, and standing athwart, the left’s assaults on speech would be a good place to start. KEEP READING

A week ago, Charlie Hebdo was a niche publication little known outside France, with a circulation of 60,000. On Wednesday the satirical newspaper's first issue since last week's deadly attack on its staff went on sale with an initial print run of 3 million copies and front-page coverage around the world.

Readers in France mobbed newsstands to buy a copy and European newspapers reprinted Charlie Hebdo's cartoons as a gesture of solidarity. But the decision to depict the Prophet Muhammad on the cover, holding a sign saying "Je suis Charlie" (I am Charlie), angered many Muslims, who called it a renewed insult to their religion.

Many Muslims believe their faith forbids depictions of the prophet, and reacted with dismay — and occasionally anger — to the latest cover image. Some felt their expressions of solidarity with Charlie Hebdo after last week's attack had been rebuffed, while others feared the cartoon would trigger yet more violence.

"You're putting the lives of others at risk when you're taunting bloodthirsty and mad terrorists," said Hamad Alfarhan, a 29-year old Kuwaiti doctor....

The Hackers, The Congressman, and Sharyl Attkisson´s Book Party

Attkisson, the Emmy-winning investigative reporter who left CBS News this year, spent Thursday evening at a Georgetown mansion, celebrating the release of her reporting memoir, "Stonewalled." Her hosts, defense analyst Michael Pillsbury and arts patron Susan Pillsbury, had hosted Donald Rumsfeld in the same grand rooms and zen garden when the former defense secretary published a compilation of learned wisdoms. Attkisson's book was even more important, alleging that the federal government established "a backdoor link" to access her computers after her reporting on the Fast and Furious and Benghazi scandals. The connected had come out: Howard Kurtz, Grover Norquist, Juan Williams, Kurt Bardella, Carl Cannon, Byron York, and the outgoing House Oversight chairman, Representative Darrell Issa.

Attkisson thanked the guests, as well as her colleagues at CBS who'd lived through her hell of reporting great stories and seeing them spiked for political reasons. The reception to her book, said Attkisson, had been positive "even from some of my colleagues that I wasn't quite sure about." It had been negative from the people who were not really interested in journalism.... A great read, KEEP READING

SPYING ON SHARYL

Reporter Sharyl Attkisson’s new book, “Stonewalled: My Fight For Truth Against the Forces of Obstruction, Intimidation, and Harassment in Obama’s Washington,” goes into detail about the insertion of viral monitoring software into her computer. It’s a problem she has only spoken vaguely about in the past. It turns out more than just her computer was compromised, as described in a lengthy summary by Erik Wemple at the Washington Post:
“[B]y November 2012,” she writes, “there are so many disruptions on my home phone line, I often can’t use it. I call home from my mobile phone and it rings on my end, but not at the house.” More devices on the fritz at Attkisson Central: “My television is misbehaving. It spontaneously jitters, mutes, and freeze-frames,” she writes, noting that the computers, TVs and phone all use Verizon’s FiOS service. At one point, “Jeff” inspects the back of Attkisson’s house and finds a “stray cable” attached to her FiOS box. That cable, he explains, could be used to download data.

Next big moment: Attkisson gets her computer checked out by someone identified as “Number One,” who’s described as a “confidential source inside the government.” A climactic meeting takes place at a McDonald’s outlet at which Attkisson and “Number One” “look around” for possibly suspicious things. Finding nothing, they talk. “First just let me say again I’m shocked. Flabbergasted. All of us are. This is outrageous. Worse than anything Nixon ever did. I wouldn’t have believed something like this could happen in the United States of America.” That’s all coming from “Number One.”
Here’s a bombshell story in which a veteran reporter accuses the Administration of hacking her computers, destroying her data, and setting her up to take the fall for a crime if she got too far out of hand. Her story merits due diligence, of course, but she isn’t coming to the table without evidence. She also speaks of increasing hostility from her superiors at CBS as she dug deeper into stories damaging to the Administration, which is pretty much the template for the Heroic Crusading Reporter narrative journalists have embraced for generations. Shouldn’t this be a huge story – at least big enough to require the usual ritual excuse from Obama that he knew nothing about Sharyl Attkission’s travails until he read about them in the newspaper?

Breitbart Reporter Covering N.H. Senate Race Ordered to Leave Democrat’s Press Conference

Perhaps she doesn't like freedom of the press --
unless it's sympathetic to her agenda.

◼ Breitbart News reporter Matthew Boyle was removed, without explanation, from a campaign event for Sen. Jeanne Shaheen in Exeter, N.H., yesterday despite the event having been advertised as a press conference open to media.

Breitbart News editor in chief Alex Marlow says the decision to block Boyle demonstrates hostility toward a free press.

“We are in a new era of media where large and influential news outlets treat Democrats much like the mainstream media has always treated Republicans: with a healthy skepticism,” Marlow told The Daily Signal. “The First Amendment gives us freedom of the press, but apparently Senator Shaheen believes that right only applies to publications sympathetic to her agenda. This should be troubling not only to conservatives, but to anyone who values the free flow of ideas.”

White House to Media: Sit Down and Don’t Interview

...It has vigorously prosecuted low-level national-security leakers — while it ignores friendly leakers from the White House who puff up its image. This has led former Washington Post editor Leonard Downie to observe, “In the Obama administration’s Washington, government officials are increasingly afraid to talk to the press.” Last year, the Committee to Protect Journalists concluded that Obama “will surely pass President Richard Nixon as the worst president ever on issues of national security and press freedom.”

The White House’s contempt for the news-gathering process extends to the most petty incidents. On Monday, Michelle Obama came to Milwaukee to campaign for Democrat Mary Burke, who is challenging Governor Scott Walker. To the astonishment of reporter Meg Kissinger of the Milwaukee Journal Sentinel, aides to Obama and Burke told her she could not talk to the crowd at a Burke event in Milwaukee.

“Assigned to cover Michelle Obama’s speech today and was told by a Mary Burke aide and one for the White House that I could not speak to the people in the crowd,” she recounted on her Facebook page.

“To say that I was creeped out is an understatement. This is what reporters do in America: we speak to people. At least that’s how I’ve been doing things — at all kinds of political events — since 1979....”

NYT reporter: Obama administration ‘the greatest enemy of press freedom’ in a generation

◼ New York Times reporter James Risen called the Obama administration “the greatest enemy of press freedom that we have encountered in at least a generation” on Friday, explaining that the White House seeks to control the flow of information and those who refuse to play along “will be punished.”

...The result is a “de facto Official Secrets Act,” Risen explained, making the current White House “the greatest enemy of press freedom that we have encountered in at least a generation.” And the media has been “too timid” in pushing back against the onslaught....
