Funding for amnesty hasn't been eliminated - yet - but this might be a pretty good first step toward it. Read to find out why.

On to the Senate.

Neither the process nor the result was pretty. In the end, John Boehner was John Boehner insofar as he wanted more than anything to avoid a government shutdown, which meant he would sacrifice amnesty de-funding to get a spending bill passed if that's what it took. And it did, because 57 Democrats came to his rescue by supporting CRomnibus - even though they were furious about the rollback of some of Dodd-Frank - after 67 Republicans bailed because the bill let Obama's executive amnesty off the hook.

So the bill is a moderate's dream and is hated by both the left and the right, which sets up some interesting dynamics when the Senate takes its turn. But in a way, amnesty doesn't get off the hook entirely...

If Republicans play this right - I know, I know - this could prove to be more of a victory on the amnesty question than it seems today. By passing a bill that funds the entire government except Homeland Security through September, they've removed the Republicans-want-to-shut-down-the-government nonsense from the equation and now set up a situation where Obama pretty much has to negotiate with them come January to get funding restored for DHS.

I think that was always the idea - that you wait until you've really got control of both houses after the first of the year and then you put the squeeze to him. Passing CRomnibus under the current Congress puts you in a stronger position to do that because you take away the shutdown as Obama's opportunity to change the media narrative and make Republicans the bad guys.

The Definitive Guide to How Obamacare is Destroying American Lives

(H)ere are the tales of many, many, many real Americans. Share this with your friends. Every time some Statist nincompoop extols the virtues of Obamacare; every time they insist that the “Affordable Care Act” has done nothing but “help” low and middle income families; every time they babble incoherently about how Obamacare isn’t “perfect” but it’s still “better” than what we had before — show them this. Challenge them to read what is happening out there. This isn’t abstract. It isn’t academic. It isn’t a matter of ideology. It isn’t even an issue of constitutionality (although it’s that, also). This is about people. People with kids, and bills, and health problems. This is about people who can no longer afford their health coverage, their mortgages, their lifesaving medication. This is about doctors and nurses leaving medicine behind, driven away by destructive bureaucratic interference. This is about moms and dads losing their jobs so that their employers can compensate for the financial burden of Obamacare. This is about people without insurance because of Obamacare, now being fined for not having insurance because of Obamacare. This is about business owners driven to the edge of bankruptcy. This is real. We heard a lot of fantasies about what Obamacare was “supposed” to accomplish, now it’s time to talk about what it’s actually doing.

So when they say you are “heartless” for opposing Obamacare, show them why it’s heartless to support it.

Sure, the President, the media, Hollywood and the DC elite have touted some “success stories.” But they are few and far between — and they come at a cost. This is that cost. For every person thanking his lucky stars for this new healthcare entitlement, thousands of low and middle income families are suffering.

Is that fair? Is that compassionate? Is that moral?

The Next Step: Four Ways to Fight Obamacare

He suggests that, rather than fight among themselves about whether or not the Cruz-Lee strategy was good or bad, they should focus on the following four things: - Veronique de Rugy/National Review
Stop the Medicaid expansion in the states.
Get states, employers, and citizens to challenge the IRS’s illegal Obamacare taxes.
Educate states about how to block the IRS’s illegal taxes legislatively.
Urge House investigators to subpoena all materials related to the IRS’s illegal taxes.

The last three points are very important.

Even die-hard supporters like Ezra Klein have called it a “disaster.” Former Obama press secretary Robert Gibbs has said heads should roll, and nobody knows whether the administration can get its act together before the health insurance “Exchanges” crater. If it can’t, the defund strategy will make all ObamaCare opponents appear prescient....

A good test of whether defunders or detractors are more committed to stopping ObamaCare will be which side is the first to put away the knives and get to work.

A group of 21 conservative members of the House of Representatives sent a letter late Thursday to all 46 Senate Republicans warning them that if they voted for cloture on the continuing resolution in the Senate—which would put Senate Majority Leader Harry Reid (D.-Nev.) in a position to reinstate Obamacare funding with just 51 partisan votes--the House conservatives would consider that vote for cloture the same as if these Republican senators had voted for Obamacare itself.
“As you are well aware,” the House conservatives wrote, “it is highly likely that Majority Leader Harry Reid will move to amend the House-passed CR and remove the language from the bill that defunds Obamacare before sending it back to the House.

“As you are also aware,” the conservatives wrote, “such a motion can only proceed if three-fifths of the Senate invokes cloture and allows this amendment process to begin. Simply put, the only chance that Senator Reid has to pursue this course of action is if six or more Republican Senators join the Democrats in voting to invoke cloture.

“Therefore,” the House conservatives said to every Republican senator, “it shall be our policy to regard any cloture vote that gives Senator Reid a green light to reinstate Obamacare into this CR the same as a vote for Obamacare itself.”

More Than 21 Hours Later, Ted Cruz Has Been Cut Off

By Wednesday morning, Cruz and some of his colleagues were still standing. He was cut off by a new day of Senate business at noon by Senate Majority Leader Harry Reid.

It was not a filibuster. But it was a very, very long speech from the Texas senator who has been the center of attention in D.C.'s budget fight, and the Senate leader in a doomed-to-fail movement to strip funding for Obamacare out of any resolution that Congress passes to fund the government. If Congress fails to come to an agreement, the government will shutdown at the end of September.

Ted Cruz stood up to "make D.C. listen," he said repeatedly. "Washington depends on the American people not paying attention."

But what we heard during the duration of Sen. Cruz's speech was his view of how to be successful in modern American politics. And, in the reactions to his speech from members of his own party, we may get a sense of just how successful the ambitious senator can be.

...The Senate rules are byzantine, resulting in the need for counter-intuitive maneuvering. Coupled with the lack of will in the Senate Republicans, those rules likely doom Cruz to failure this time. But it’s a failure of the will at many levels.

The reason Cruz is called foolish is that Democrats are willing to play a game of chicken over shutting down the government, and Republicans are not. That is the complete opposite of the media narrative willingly adopted by Cruz’s Republican opponents.

REID BLOCKS CRUZ, KEEPS SHUTDOWN, DEFAULT ON TABLE

◼ On Monday afternoon, Texas Sen. Ted Cruz asked for unanimous consent to immediately consider the House Continuing Resolution to fund the government and avoid a shutdown. The legislation would also take steps to avoid a default on government debt while Congress debates a raising of the debt ceiling. Majority Leader Sen. After Reid's block, Cruz noted in remarks that the move keeps open the possibility of a government shutdown next week and a default on the national debt later in October. "He is willing to risk a government shutdown," Cruz said about Reid. "He is willing to force a government shutdown," to continue funding ObamaCare.
Cruz noted that if the Senate passed the House CR all the talk about a shutdown or government default "would just go away. Those count-down clocks that are showing up on TV, would disappear."

Defunding Obamacare would defund Obamacare; but NOT funding Obamacare would NOT DEFUND Obamacare

◼ A slew of recent articles explaining (Bloomberg, Washington Post, National Journal) the effort to defund Obamacare have all pointed out an important fact: a government shutdown wouldn't defund Obamacare. - Timothy P. Carney/Washington Examiner @TPCarney

But these articles have all glossed over another important fact: defunding Obamacare would defund Obamacare.

Guess what doesn't require annual appropriations? Almost all of Obamacare. So, yes, B-Berg, NatJo, and WaPo, a government shutdown won't defund Obamacare.

But that's not the whole story. The House passed a CR numbered H.J. Res 59. This House CR, in addition to funding the government at current levels, also contains a defund-Obamacare provision. This provision at least aims to defund Obamacare, and I think it does:
Notwithstanding any other provision of law, no Federal funds shall be made available to carry out any provisions of the Patient Protection and Affordable Care Act...
No entitlement to benefits under any provision of the Patient Protection and Affordable Care Act... shall remain in effect on and after the date of the enactment of this joint resolution, nor shall any payment be awarded, owed, or made to any State, District, or territory under any such provision.

"I don't think that Harry Reid and President Obama should shut down the government"

Cruz said he hoped Reid would allow a 60-vote threshold for all amendments to the funding bill, which would give Republicans a chance to defeat them, but conceded that was unlikely.

Expecting Reid to just gut the Obamacare provision and then send the bill back to the House, Cruz has called on House Republicans to pass individual appropriation bills for individual departments, like the Pentagon.

"See if Harry Reid is willing to shut down the military because he wants to force Obamacare on the American people," he said.

Regardless, Cruz thinks that the onus is squarely on Democrats if the government shuts down as scheduled in eight days.

"I don't think that Harry Reid and President Obama should shut down the government," Cruz said.

Filibuster the House CR? Cruz, Other Conservatives Say ‘Yes’

◼ Sen. Ted Cruz said Friday that Republican senators should, in effect, filibuster the House-passed continuing resolution in the Senate. - CQ RollCall

The Texas Republican is calling on his colleagues to oppose limiting debate on it, warning against what he calls procedural trickery.

“Step two is the Senate, where all accounts suggest Harry Reid plans to use procedural gimmicks to try to add funding back in for Obamacare,” Cruz said. “If Reid pursues this plan — if he insists on using a 50-vote threshold to fund Obamacare with a partisan vote of only Democrats — then I hope that every Senate Republican will stand together and oppose cloture on the bill in order to keep the House bill intact and not let Harry Reid add Obamacare funding back in.”

“Now is a time for party unity; Senate Republicans should stand side-by-side with courageous House Republicans,” Cruz said.

...Of course, if GOP senators actually follow Cruz and Hoskins’ advice, they will, in effect, be voting against a bill that includes Obamacare defunding. The vote to strike that language is not expected until after cloture is invoked, and it will take only 51 votes to succeed. That’s why Cruz may ultimately be proved correct when he says Democrats have the votes to send the measure back to the House, without Obamacare funding.

◼ House passes spending bill to defund Obamacare - Stephen Dinan/Washington Times

House Republicans passed their stopgap funding bill Friday to keep government open while terminating the new health care law, setting up a final showdown next week with Senate Democrats and President Obama who have firmly rejected that.

The 230-189 vote, which split almost exclusively along party lines, is the precursor to the big action next week, when the Senate is expected to strip out the health care provisions and send the bill back to the House — where Republicans will have to decide whether they can accept it at that point.

All sides are racing a Sept. 30 deadline, which is when current government funding runs out. The new measure would fund the government through Dec. 15, essentially at last year’s levels, and would leave the budget sequesters in place.

CONGRESSMAN: 'CLOSE TO 250' HOUSE MEMBERS READY DEFUND OBAMACARE TODAY

◼ On a conference call with Sen. Ted Cruz (R-TX) and Rep. Jim Bridenstine (R-OK), Rep. Matt Salmon (R-AZ) said “the American people [are] finally taking their government back.” - Matthew Boyle/Breitbart

“When it first started, a lot of people came out and said ‘technically it can’t be done,’” Bridenstine said. “’Technically, this is a Continuing Resolution and Obamacare is on the mandatory side so it can’t be defunded with a Continuing Resolution.’ And we proved that it can be defunded with a Continuing Resolution. After we proved that it could be defunded with a Continuing Resolution, then interestingly people started listening to the American people a little bit more. Then it was ‘politically, it can’t be done. We don’t have the votes. We don’t have the votes.’ We heard that over and over and over again. Well, tomorrow, we’re going to take a vote. And tomorrow we’re going to find out in the House of Representatives that we do, in fact, have the votes. And then it’s going to go to the Senate.”

Bridenstine said conservatives may in fact be able to defund Obamacare in the Senate, too, just like the House.

“Interestingly, everybody is going to say that the Senate can’t prevail,” Bridenstine said. “But they have said over and over again, and Ted Cruz said it just right. The pundits were saying it can’t be done. But the reason we have come this far is because of how many people have been reaching out to their members of Congress, how many people have been talking to their friends and their neighbors and going to DontFundIt.com and signing the petition and getting their friends and neighbors to sign the petition. It has absolutely changed the dynamic of this conversation.”

Tom McClintock: The house will be passing a continuing resolution to keep the government open. It will continue to fund all programs at their current levels - except Obamacare.

As a result of Obamacare, people are losing their jobs or seeing their hours cut back, their premiums are skyrocketing, their plans are being cut back, their employers are dropping their plans. De-funding Obamacare is hugely important to help relieve this pain on American families.
