The Obama Administration’s Attempt to Balkanize Hawaii

◼ This Obama Administration Proposal Would Effectively Authorize Some Americans Seceding - The Daily Signal

In its latest assault on the U.S. Constitution, the Obama administration is proposing to recognize so-called “Native” Hawaiians as an Indian tribe entitled to separate and become an independent sovereign and to “reestablish” a “government-to-government relationship between the United State and the Native Hawaiian community.”

Such an unconstitutional action would amount to authorizing secession for certain residents of Hawaii.

It would also implicitly authorize government-sanctioned, discriminatory conduct against any other residents who don’t meet the explicit ancestry and blood-quantum requirements to be considered a “Native.” This would balkanize Hawaii, dividing the islands into separate racial and ethnic enclaves, and undo “the political bargain through which Hawaii secured its admission into the Union.”

At the end of June, the Department of the Interior issued an “Advanced Notice of Proposed Rulemaking” that set out the administration’s plan, with the opportunity for the public to file comments ending on August 19. No doubt to its chagrin, the administration encountered strong opposition at a series of hearings the Interior Department held in Hawaii in June and July, with one official from the state Office of Hawaiian Affairs being loudly booed when she declared her support for the plan.

Both unconstitutional and bad public policy, this action would balkanize Hawaii, dividing the islands into separate racial and ethnic enclaves. It would also undo “the political bargain through which Hawaii secured its admission into the Union … when native Hawaiians themselves voted for statehood, thus voluntarily and democratically relinquishing any residual sovereignty to the United States.”...

What the Interior Department does not mention, however, is that it encountered strong opposition at a series of ANPR hearings held in Hawaii.[7] At one such hearing, “the vast majority of native Hawaiians who testified” were “indignant and even outraged, that the federal government would try to insert itself or side with any faction of native Hawaiians,” and “they scolded, shouted at and questioned the motives of Interior Department officials.”[8] Colette Machado, chairperson of the state Office of Hawaiian Affairs, “encountered loud protests and boos when she declared her support for the federal government and encouraged officials to move forward” with the proposal.

“Not only is it unconstitutional, but the administration has no authority to enter into such a relationship,” von Spakovsky said. “It is a sign of how the Obama administration believes in official discrimination and sanctions it. They continue to divide up our country and raise the walls between different races. I find it disgusting that they want to do this.”

HONOLULU—A proposal by the Obama administration to create a new relationship with ethnic Hawaiians may have backfired.

The U.S. Department of Interior is holding a series of hearings about the plan, which, it said in a statement, would determine “the best path forward for honoring the trust relationship that Congress has created specifically to benefit Native Hawaiians.”

...Hawaiian activist Bumpy Kanahele, who heads the organization Nation of Hawaii, told Interior officials: “We don’t need you to come in to tell us how to govern ourselves. Let us figure it out.”

University of Hawaii Hawaiian studies professor Jonathan Osorio said the feds shouldn’t intervene and impose additional “aggression upon our nation.”

While the debate is stirring up an already racially divided community, constitutional experts argue President Obama and the Department of Interior have no legal right to create such a relationship and has no business holding these hearings in the first place....

“The current effort to recognize a separate ethnic tribe by the Department of the Interior is unconstitutional because, under the Constitution, it is the Congress that has the plenary power to recognize tribes and ratify treaties,” Lilly said. “That power does not reside in the executive branch of the federal government or with the various states. So the current effort aimed at creating a tribe of Hawaiians has no legal basis.”

Hawaii sends Arizona verification of Obama's birth

◼ Arizona Secretary of State Ken Bennett said Tuesday night that he has received information from Hawaii that proves President Obama's American birth and satisfies Arizona's requirements for having the president on the upcoming election ballot. - AZ Central

Bennett said the issue is now resolved from his point of view. He has cancelled a planned Wednesday news conference where he was expected to discuss the issue.

"I'm happy that we got what we asked for and that's what I was expecting all along," Bennett said Tuesday night.

Bennett made national news earlier this month when he asked Hawaii to verify Obama's birthplace to ensure the President is eligible to appear on Arizona's November ballot.

While you were sleeping, Romney rebounds to win Hawaii and American Samoa

Great headlines for Santorum last night, probably today too, as he tries to grasp The Ring as conservative alternative to Romney.

But guess what? Nothing changes. Due to the new proportional allocation, Santorum, Gingrich and Romney will each get about a third of the Alabama and Mississippi convention delegates. And Romney's lead of about 250 delegates remains intact.

Except -- oh, wait! -- after everyone went to bed on the mainland, Romney won all nine delegates from American Samoa. And in the Hawaii caucuses, he won again, capturing 45% of the votes and the lion's share of the 17 delegates. Santorum trailed with 25%, followed by Paul at 19% with Gingrich back at 11%.

So once again, the results of Santorum's big wins are that Romney's lead widens a little more. Even better news for the former governor, Santorum and Gingrich both vowed to press on, meaning voters who don't prefer Romney will still split.

...if Gingrich is serious about mounting a comeback, Louisiana may well present his best opportunity. It will be interesting to see if the polls shift in response to Santorum’s wins last Tuesday night, and change the Gingrich campaign’s calculations about whether such a comeback is still even remotely possible.

The one word that that was on the lips of nearly every Hawaii Republican I spoke to regarding the March 13 caucus was "excited."

The Aloha State will see its first ever Republican presidential caucus in one week and local conservatives are already motivated and anxious to cast their votes for what may very well be the next president of the United States.

Hawaii, which has 17 proportionately awarded delegates at stake, trails the drama of today's Super Tuesday contests but has unique significance as President Obama's home state. Conservatives believe that the upcoming caucus, if turnout is large enough, could serve as a symbolic vote of no-confidence against the Obama Administration.
