(E)xperts say Hillary arguably could be charged until March 2025





...prosecutors favor the more severe 18 U.S. Code § 793, which is part of the notoriously tough Espionage Act. The law restricts possession or retention of information “relating to the national defense" and carries a possible 10 years in prison, with a 10-year statute of limitations....

Because of the passage of time, it’s possible Clinton cannot be charged under the gentler statute. She left office in February 2013, and the law’s specific wording covers when someone "knowingly removes such documents or materials without authority and with the intent to retain" them — written in such a way that the clock may begin when removal happens.

“I think that under this statute, the proscription is on the removal and it would run from removal,” prominent defense attorney Barry Pollack told the Washington Examiner.

But under the harsher law, the 10-year countdown arguably started in late March 2015, when tech aide Paul Combetta had what he told the FBI was an “oh shit” moment and deleted stored emails using the software BleachBit, after forgetting to do so months earlier.

Under the tougher law, "I would think its statute [of limitations] would not start to run as long as the person has the documents,” Pollack said. “It has a ten-year limitations period, not five.”...

The Obama administration's selective releases portrayed Tehran as an enemy of the extremists. There's more to it.







...Ryan Trapani, a spokesman for the CIA, told me Thursday: "Documents collected during the bin Laden raid, which have been declassified, indicate Iran and al-Qaeda have an agreement to not target each other. The documents indicate bin Laden referred to Iran as the 'main artery' for al-Qaeda to move funds, personnel and communications."

Some of this was known before. The U.S. government has sanctioned members of al-Qaeda's network in Iran going back to the Obama years. The State Department's annual reports on terrorism also touch on this.

Nonetheless, it's understandable why many observers would dismiss the notion of an Iran-al-Qaeda connection. Earlier releases of the bin Laden files under the Obama administration emphasized the Iran-al-Qaeda rivalry. All the while documents that showed cooperation remained classified....

Current and former Trump administration officials tell me the declassification of the documents was a priority for the new president's team. The former senior director for intelligence at the National Security Council, Ezra Cohen-Watnick, pressed the CIA and the Office of the Director of National Intelligence to declassify the bin Laden documents. He met with resistance because translations, vetting the documents and providing official analysis would sap resources from higher priorities, according to these current and former officials. In the end, the CIA released most of the documents on Wednesday without translations and analysis, in hard-to-download zip files.

In the coming days and weeks, outside analysts and experts will be able to see for themselves the extent of Iran's cooperation with al-Qaeda....

A Pentagon subcontractor (for Healthcare) has leaked personnel data on military staff, inc. top-secret clearance holders.



A Pentagon subcontractor has exposed reams of highly sensitive details belonging to active military healthcare professionals online, some of which hold top-secret security clearances.

Potomac Healthcare Solutions, a subcontractor brought on board to supply healthcare professionals to the US government and military organizations through its parent Washington, DC.-based contractor Booz Allen Hamilton was the source of the data....

Many of those named in the leaked personnel files are linked to SOCOM's Preservation of the Force and Families (POTFF) program, a scheme that aims to ease the psychological and physical burdens often placed on military personnel and their families through unit-specific teams of healthcare professionals and counsellors.

The files include names of social workers, physical therapists, nurses and assistants, doctors, and psychologists, which alongside detail the states of their residency, pay scales, contract start and term dates, units and work locations.

The documents supplied by Vickery also revealed a "master tracking list" of POTFF personnel personal data and their security clearance levels.

Some of those possess "top secret" clearance, including access to sensitive compartmented information (TS/SCI) -- typically only granted to vetted staff who are then hired to work on sensitive special access programs.

Because acceptance of a pardon amounts to a confession of guilt, the acceptance by Mrs. Clinton would, to a degree, besmirch both Mrs. Clinton and also Pres. Obama. After all, Mrs. Clinton was Pres. Obama’s secretary of state. If she was committing illegal acts as secretary, it happened literally on his watch.



...What looks like one question—will the president pardon Mrs. Clinton?—turns out, on analysis, to be two. The first question is: Would Mrs. Clinton wish to receive a pardon?

That question seems to be a proverbial no-brainer. Surely, any person who had been in federal government would be eager to receive a presidential pardon, because it eliminates even the possibility of federal prosecution. That looks like all upside and no downside.

But there is a downside, and it isn’t trivial. A pardon must be accepted by the person who is pardoned if it is to effectively stymie any prosecution.

Furthermore, there is solid legal precedent that acceptance of a pardon is equivalent to confession of guilt. A U.S. Supreme Court case from 1915 called Burdick v. U.S. establishes that principle; it has never been overturned....

Away from the cameras and the briefings, the Clintonites held their bosses in contempt. Neera Tanden, a supposed close associate of Hillary, blasted her instincts as “suboptimal” and described her as suffering from a character problem. And there was never any doubt as to what was going on.





And what did they think of Hillary? Did they believe their defenses of her wrongdoing?

Podesta and Tanden ridiculed her associates for the cover-up. “Why didn’t they get this stuff out like 18 months ago? So crazy,” she wondered. “Unbelievable,” Podesta wrote. “They wanted to get away with it.”

...Tanden ridiculed Cheryl Mills for the mess. Mills fired off an email to Podesta warning that Obama’s denial wouldn’t hold up. “We need to clean this up -- he has emails from her -- they do not say state.gov,” she warned.

Obama had offered his usual denial claiming to have only learned about the scandal from the media. The revelation that Hillary had emailed Obama from her illegal address would show that he had lied. But meanwhile his people struggled to reinvent his lie by claiming that while he knew about her illegal address, he didn’t know that it was illegal. This put his lie in line with Hillary’s lie.

There was only one problem.

When in doubt, the Clintons take refuge in the final lie that you may be able to prove that they did wrong, but not that they meant to do wrong. That was Hillary’s final email defense to the FBI. Spliced with claims of memory loss due to a concussion was that old Sergeant Schultz favorite, “I know nothing.”

But that defense completely falls apart once you prove that they did know. That is what the leaked emails have begun doing. They are establishing that the Sergeant Schultz defense is utterly hollow.

Cheryl Mills knew. John Podesta knew. Barack Obama knew. And Hillary Clinton knew.

Plotting to deceive



In emails from March 2015, Merrill suggested a strategy - ultimately nixed by Clinton herself - of having comedian Larry Wilmore and Bill Clinton joke during an event for the Clinton Global Initiative charity in Coral Gables, Florida, before having Clinton join them on stage.

Merrill laid out the scenario in emails to Podesta and other aides: “Wilmore could sit down with WJC and Chelsea and say something like ‘Thanks for having me here, it’s a pleasure. And I should tell you, I just emailed HRC (I hear she’s a big emailer), and asked if she’d join as well. (Laughter).’” He added that Hillary Clinton could then walk out “to applause.”

“It would be just light-hearted enough while giving her the opportunity to address this seriously, be a little conciliatory as discussed, and then get back to a discussion about CGI etc.,” Merrill wrote in the email.

In the end, Hillary Clinton’s team drafted talking points Clinton used at the news conference at the United Nations.

Clinton said she “fully complied with every rule that I was governed by” and that “there is no classified material” among her work-related emails.

Both of those statements were later proved false....

Clinton’s email practices were not the only controversy her campaign’s brain trust was addressing.

On October 2015, speechwriter Dan Schwerin circulated among top Clinton advisers a draft of her opening statement to the House Select Committee on Benghazi, to be delivered the following week.

The draft itself wasn’t attached in the emails published Tuesday, but other messages showed how it was shaped, including a section referring to Ambassador J. Christopher Stevens, who was killed in the Sept. 11, 2012, attack.

“We might consider softening the ‘Chris did not believe retreat was an option - and neither do I’ line,” wrote Katherine Turner, a law partner of Clinton’s personal attorney David Kendall. “I don’t think we want to suggest that there was a commitment to be there at any and all costs.”

Following Clinton’s tense Oct. 22 testimony, Podesta proposed in an email that she could publicly joke, “I used to be obsessed with Donald Trump’s hair, that was until I got to spend 11 hours staring at the top of Trey Gowdy’s head,” a reference to the slicked-back white coif of the South Carolina Republican who chairs the committee.
