A few months after lefty activists crowded Washington D.C. for the Women’s March, activists from many of those same organizations went to bat for a serial rapist and murderer.

Ledell Lee’s victims were all women. While he was on trial for the rape and murder of Debra Reese, the testimony of three of his rape victims was presented. Lee had made a habit of knocking on doors and asking to borrow some tools to see whether a woman’s husband might be home....

When Lee was caught after murdering Debra Reese, the evidence tied him to these assaults and two murders. He was convicted of two rapes and sentenced to death for his crimes against Debra Reese. Justice would be done. But first justice had to elbow past the ACLU and the pro-crime lobby.

In a Supreme Court dissent written on April 20, 2017, Justice Breyer whined, “Why now?” "The state is rushing to put him to death," complained Nina Morrison of the badly misnamed Innocence Project.

But it’s her client who rushed to put his victims to death. Ledell Lee had committed his crimes in the first years of the nineties. His youngest victim is now in her forties. Arkansas had let him live for decades.

Three other Supreme Court justices, feminist heroines Ginsburg, Kagan and Sotomayor, also clamored for a serial rapist.

Midazolam, a medication approved for sedating infants, has a “risk of severe pain”, Sotomayor wailed. The “wise Latina” failed to clarify whether it’s more painful than being beaten to death with a tire thumper, being strangled behind a school building or being held underwater until you pass out....

That excuse always seemed preposterous. Solicitor General Kagan was kept totally out of the loop on the most important legal defense her Administration would ever mount, in order to keep her unsullied for the chance that she might sit on one of the most important cases the Supreme Court would ever hear?

With just weeks until the U.S. Supreme Court considers the constitutionality of President Obama's health care law, there are new calls for Justice Elena Kagan to recuse herself from the case.

Her critics point to a 2010 case regarding a San Francisco health measure, in which then-Solicitor General Kagan's office filed an amicus brief touting the newly passed health care law.

In May 2010, after Kagan had been nominated to the nation's highest court, Principal Deputy Solicitor General Neal Katyal sent her a memo outlining the cases in which she had "substantially participated." Kaytal specifically referenced the Golden Gate case, noting that it had been "discussed with Elena several times."

That's enough to convince Heritage Foundation Senior Legal Fellow Hans von Spakovsky that Kagan shouldn't take part in the current health care case before the high court.

"I don't see how any ethical lawyer adhering to professional codes of conduct could not consider that they need to recuse themselves from this case," he said.

Justice Kagan recuses herself - on Arizona immigration case

◼ The Supreme Court announced Monday it will take the case of Arizona’s tough immigration crackdown law, adding yet another contentious clash between the Obama administration and the states to its docket. - Washington Times

The case, which has attracted national attention, pits Arizona against the Obama administration, which sued and won court orders blocking implementation of most of the law at both the district and appeals court levels. Arizona’s law spawned a host of copycat laws in other states, and most of them have likewise seen their key provisions blocked by court challenges from the administration.

At stake is Arizona’s goal of granting state and local police the power to check the immigration status of persons they encounter during their duties, such as traffic stops. Administration lawyers argue the state statutes infringe on what is federal responsibility to police the borders and set immigration policy.

In its notice, the court said Justice Elena Kagan had recused herself from the decision to take the case.

Internal Justice Department email communications made just days before the House of Representatives passed the Patient Protection and Affordable Care Act show that then-Solicitor General Elena Kagan was brought into the loop as DOJ began preparing to respond to an anticipated legal complaint that Mark Levin and the Landmark Legal Foundation were planning to file against the act if the House used a procedural rule to “deem” the bill passed even if members never directly voted on it.

In another internal DOJ email communication that same week, Kagan alerted the chief of DOJ’s Office of Legal Counsel to the constitutional argument that a former U.S. Appeals Court judge was making against the use of this rule.

Then, during Kagan’s Supreme Court confirmation process four months later, Republicans on the Senate Judiciary Committee asked her in writing if she had “ever been asked about your opinion” or “offered any view or comments” on the “the underlying legal or constitutional issues related to any proposed health care legislation, including but not limited to Pub. L. No. 111-148 [PPACA], or the underlying legal or constitutional issues related to potential litigation resulting from such legislation?"

Kagan answered both questions: “No.”
