Democrats obstruct DHS stopgap funding bill — shutdown imminent

Hell bent on pursuing legislation that would allow for the dissolution of Congressional powers (a.k.a. Obama’s Executive immigration overreach), House Democrats refused to pass a short term funding bill for DHS. The bill would’ve funded DHS through March 19 and prevented an agency shut down.

Allow funding for the Department of Homeland Security to lapse or engage in the legislative process.

Those are the only two options Senate Democrats have at this point. Everything else transcribed in the press or recited by television pundits is nothing more than a distraction. Senate Democrats, of course, deny that binary choice, but their denials are only accepted by those who can’t — or won’t — understand the wonderfully complex rules of the United States Senate.

Before diving into the process, it is worth taking a minute to understand the politics.

The implication of the Democrat-led filibuster is that Homeland Security funding will lapse and our nation’s border patrol agents will have their paychecks withheld after Feb. 27. While those fine men and women continue to work without pay, the Department of Homeland Security will be preparing to grant legal status and work permits to those who are in the country illegally. To make matters worse, some of these individuals will use their newly issued Social Security numbers to claim four years’ worth of tax credits....

There is likely to be some temptation to avoid this fight now that a Fifth Circuit judge has issued an injunction and the administration announced it would halt implementation of the president’s amnesty. While Obama’s actions are clearly unconstitutional, conservatives have little reason to trust the courts to make the right decision. What’s more, the administration said they will prevail in court and begin implementing and expanding the amnesty program.

Even with the stunning news out of Texas, Democrats have just two options. They can deny paychecks to border patrol agents or they can engage in the legislative process. It is that simple.

“Republicans in Congress, to their credit, have said ‘OK, look here’s what’s going to happen. If the president wants to do this, fine, but we’re not going to facilitate it’…the Democrats won’t even let us debate that bill. They’re not willing to even take it up. They’re not even willing to subject it to an amendment process where they could change it into something that they want, they’re obstructing, they’re being purely obstructionist because they’re trying to protect the president in his unconstitutional action” he stated. And “they [Senate Democrats] are yet again saying ‘I’m willing to back the president of my party, just because he’s the president of my party, even when he betrays his oath to the Constitution, and in the process, I’m going to betray mine. That is wrong. They’re subjecting our country to harm as a result, and they’re willing even to try to shut down the Department of Homeland Security simply so they can protect the president in his lawless, unconstitutional action. That is wrong.”

Lee later added that Democrats were “willing to shut down the Department of Homeland Security” in order to protect the president’s executive action. He further declared that president is “asking all these Democrats in the Senate, all 46 of them, to join him in his plan to subvert the Constitution…they reject the notion that it is the prerogative of the legislative branch to make the law, and if we allow the president to do this, and we continue to fund him in this, set aside for a minute whether you’re Republican or Democrat, set aside for a minute whether you’re pro-amnesty or against amnesty as a matter of policy. Just from an institutional standpoint, when you at Congress as an institution, we as a Congress will become inept if this becomes the new norm.”

On to the Senate.

Neither the process nor the result was pretty. In the end, John Boehner was John Boehner insofar as he wanted more than anything to avoid a government shutdown, which meant he would sacrifice amnesty de-funding to get a spending bill passed if that's what it took. And it did, because 57 Democrats came to his rescue by supporting CRomnibus - even though they were furious about the rollback of some of Dodd-Frank - after 67 Republicans bailed because the bill let Obama's executive amnesty off the hook.

So the bill is a moderate's dream and is hated by both the left and the right, which sets up some interesting dynamics when the Senate takes its turn. But in a way, amnesty doesn't get off the hook entirely...

If Republicans play this right - I know, I know - this could prove to be more of a victory on the amnesty question than it seems today. By passing a bill that funds the entire government except Homeland Security through September, they've removed the Republicans-want-to-shut-down-the-government nonsense from the equation and now set up a situation where Obama pretty much has to negotiate with them come January to get funding restored for DHS.

I think that was always the idea - that you wait until you've really got control of both houses after the first of the year and then you put the squeeze to him. Passing CRomnibus under the current Congress puts you in a stronger position to do that because you take away the shutdown as Obama's opportunity to change the media narrative and make Republicans the bad guys.

In a nod to conservative opposition, Boehner vowed an immigration fight in 2015, when Congress returns with a majority in both houses of Congress.

“[B]y the House’s action, we are setting up a direct challenge to the president’s unilateral actions on immigration next month, when there will be new Republican majorities in both chambers," he announced. "The Senate should act on this bipartisan legislation in short order.”
Mark Levin calls it embarrassing.
